Illinois Congressman Luis Gutierrez is freaking cool. A passionate pro-immigrant advocate and enemy of nativist goobers everywhere, the guy also has a sense of humor, as evidenced by his appearance on the floor of the U.S. House of Representatives this morning to introduce a rival to Pictionary: Spot the Immigrant.

Gutierrez is here playing off the language of the section 2(b) of Senate Bill 1070, the section that survived U.S. Supreme Court scrutiny, for now. 

The passage requires cops, for all lawful stops, to inquire into a person's immigration status, if "reasonable suspicion exists that the person is an alien and is unlawfully present in the United States."

Just how a police officer uses that rationale is where the profiling component rears its head. 

Defenders of 1070 will give you some mush about how the "reasonable suspicion" will be the totality of the circumstances involved, but we all know that cops are going to operate off of what they can readily identify, like, brown skin, a Latino surname or a Spanish accent.

not in my experience with LEOs in this state and others. The police look for trouble all the time..

 You went from liking "a good fight" to wanting to drop out of the conversation. Everything I have stated about the legal immigration process of my wife and stepchildren is true. We married in Mexico in 2005, and I quickly added them as my military dependents. Our processing took until 2007 for them to be able to enter the United States under non-immigrant 'K'-class visas, while their I-130's were being adjudicated. They obtained legal residency in 2008. My wife has never broken any U.S. immigration law. She toured the southern U.S. with a musical group in her late teens and early 20's, but complied with all the terms of the issued visas. The kids were born after she had stopped touring to the United States, and they have only been present from my sponsorship. I was on notice of my fifth military deployment while we waited, and the U.S. Consulate in Juarez had documentation we submitted from my command to that effect. Senator Domenci's staff acted on my request when we had delays as my deployment date neared, but fat-fingered their handling of the situation to almost cause the petitions to be cancelled. We proceeded later actions that improved how USCIS would become more timely for servicemembers sponsoring their families in the face of a deployment. What portions of how I relate things don't match up to your notion that legal immigration is quick and painless? You are willing to discount what I have said as a fabrication, while I accepted your statements of being former law enforcement at face value? Much of the comparable talk to "busing illegals to Washington" considers an immigration moratorium solely towards Mexico. Are you another that thinks I could have had a few more roadblocks and added time to get my family here?...

I agree that state and local police have enough to take care of, without putting them in the position of also enforcing immigration law. They aren't allowed to use how the Border Patrol typically determines immigration status, which is to ask for a verbal statement of citizenship. For local law enforcement, I say the old way is the best: Someone arrested has all that checked at the detention facility, and are treated accordingly.

 As a former LEO, you would know, whether you have detained (but not arrested) someone in the back of your car or not, that an officer can come up with any PC very easily after the fact. Yes, I believe that most cops are honest and stay within their proper authority, but there are bad apples in the bunch. You want us to show proof that SB1070 is impossible to be run correctly, when it fails its main premise: That it would have mimicked Federal law.

It DOES NOT MATTER. If they call ICE, the OBAMA ADMINISTRATION, has made it clear they will not co-operate. That's right, they WILL NOT CO-OPERATE. See the problem? Supreme Court says states can't enforce immigration law, it's a Federal Issue. Fed says, we won't cooperate. Nice huh. The borders are essentially open.

Whether Arpaio, or any other sheriff or cop now asks someone if they are in the country illegally, and that person even says Yes, the Obama Administration has made it clear, they won't deport them, or bother them. Don't you listen to the news, Obama practically said this. So you people can feel real good, knowing that a U.S. President doesn't even give a shit who is in this nation illegally or not? You should ask yourselves, why doesn't he give a shit, but that would be expecting too much from you people. I would agree with you, IF........IF, the Federal Government was doing its job on immigration issues. Now you either believe they are, don't care, or are lying. For my part and apparently millions of other Americans, we don't believe they are doing their sworn duty to control the border. So consequently, we agree with Pearce, Brewer, and Arpaio, as well as anyone else in that camp. It's easy to say it's a Federal issue, but we ANTI' OPEN BORDERS AMERICANS, realize the Federal Government isn't doing squat on the border, but is instead, carrying out the various OPEN BORDERS TREATIES,, NAFTA, GATT, NAU, ETC. so obviously ruinous to Americans. Can't you see this? Or is it "nativist" to see this?

 That makes no sense.  An accident happen, therefore giving the officer authority to investigate the situation and the ability to discover probable cause. SB1070 provides the Arizona officials with the ability to profile alleged immigrants based on appearance alone. They "randomly" walk up to a person and ask them their migration status. The problem is who they are "randomly" approaching.
