SB 1070: Two More Sections Enjoined by Judge Susan R. Bolton

With oral arguments scheduled to take place April 25 before the U.S. Supreme Court on Arizona's breathing-while-brown statute Senate Bill 1070, Arizona District Court Judge Susan R. Bolton today enjoined two sections of the law she had not previously put on hold in 2010, when she stymied the most egregious parts of 1070.

The sections enjoined today were targeted at day laborers, also known as jornaleros. Section 5a prevented a driver from stopping to pick up passengers "for work at a different location," if the driver's vehicle impeded "the normal movement of traffic," and section 5b would have made it illegal for that passenger to get into such a vehicle.

Bolton had previously blocked the enforcement of section 5c of the law in July of 2010, along with other sections. Section 5c essentially outlawed day laborers by making it illegal for someone in the United States unlawfully to solicit work in a public place.

At that time, the judge found that 5c conflicted with federal law regulating the employment of aliens. This, in United States vs. State of Arizona, the U.S. Department of Justice's lawsuit to block 1070. That's the same case to be heard by the Supremes.

When I go to the Home Depot @ 43rd ave & Camelback there are several people looking for work. They are mostly hispanic, their country of origin unknown to me. There will also be obvious Americans holding signs and begging for money. "Homeless please help" or something similar. I've lived in central Phoenix for 40 years and am sick of being panhandled. I'd rather have 20 day laborers looking for work than any more of these drug addicted beggars. The crack made them aggressive, the meth makes them crazy. Now, I enjoy urban living and refuse to live in fear but to try to put all the city's problems on the backs of people looking for work is more than short sighted, it's bad policy designed to score political points and just plain lazy.

The reason the hispanic's or whatever, never beg for money is because their wives or even the men, are already getting state aid of some form. In California, when the Democrat politcians were accused of giving citizens tax money to illegal aliens, they denied it. They lied. It has now been found out that they were lying all the time. Illegal aliens do get State taxpayers money, in one form or other, AND THAT'S WHY YOU DON'T SEE THEM BEGGING. Many Americans are too proud to beg. Your thinking is inverted.

At this point, Pearce & Co. are really delusional if they think the U.S. Supreme Court will reverse Judge Bolton's decision to enjoin this detrimental law.

Personally, I suspect that the U.S. Supreme Court will not only uphold Bolton's enjoinment decison, but they will actually throw out the law as a whole, resolving the DOJ lawsuit against it.

BTW, isn't GED Jan supposed to testify in front of Congress about 1070?

What American CITIZEN, citizen being the operative word, should give a damn what Judge Bolton says. Just because she's a judge? In the first place, the judge is already starting her deliberations from a faulty foundation. Creating new law, which is what she is essentially doing, isn't her job. She knows that day laboreres, when having been deteremined to be illegally in the state, need to be deported as U.S. Immigration law requires. Her job is to then turn them over to immigration authorities and that's it. But Bolton is questioning existing U.S. immigration law to begin with, and has taken away the right of law enforcement to supposedly "racially profile", so that they can't check if the day laboreres are in the State illegaly. proving that here whole rulings are worthless, in the light of EXISTING IMMIGRATION LAW. Bolton should be recalled pure and simple, because she doesn't have the best interests in upholding US. law at heart.

The president typically appoints judges to the federal bench and the U.S. Senate confirms their appointment.

In this case, Bolton made the right decison. If GED Jan & Co want to appeal it, they can.

Day laborers have ruined small businesses when they hang out in front of them and drive away customers, as has been amply documented.A lunatic judge in California, sided with the day laborers in a city called Redondo Beach California, that banned them from the location, even though they were ruining small businesses at the location, by whitsling and harassing woman that frequented that strip mall.  They will act very sexually towards me when I drive by as if they think that an older woman  alone will respond favorably - hey maybe some do but personally I find it threatening and/or offensive and I certainly will not hire them for engaging me in that manner.  There are times that I fear going to and from the store because they could just as easily steal my money or my car and often there are many of them with no security.  So yes, they can be intimidating and harm business.  That does not make me a troll or a bigot.  It makes me a fragile older female who is reasonably concerned.
