Russell Pearce's Sham Candidate, Olivia Cortes, Withdraws from LD18 Recall Race

Hours before she was to appear at a candidates' forum in Mesa and one day before a second, scheduled evidentiary hearing in Maricopa County Superior Court over her sham campaign, Olivia Cortes this morning officially withdrew her candidacy for state Senate at the Arizona Secretary of State's Office.

SOS spokesman Matt Roberts tells me her name will remain on the ballot, but that notices will be posted at the polls and on the SOS' website advising the public that she no longer is a candidate for office. Votes for her will still count, though.

By withdrawing her name, Cortes avoids the further embarrassment of the second hearing, where attorneys Tom Ryan and H. Micheal Wright had subpoenaed several witnesses linking Cortes to the campaign of state Senate President Russell Pearce.

These included: Justice of the Peace Lester Pearce (Russell's brother), Republican political operative Constantin Querard, the Senate President's nieces, Megan Sirrine and Shilo Sessions, and Diane Burns, owner of Petition Pros, the company that collected signatures for Cortes.

Ryan said he would now seek to have tomorrow's hearing canceled.

"The Pearce forces did not want this hearing to go forward tomorrow," he told me, "for the same reason I don't order steak at an East Valley Denny's. In both instances, we know it won't go down well."

He added, "We were subpoenaing all the right people. We were closing in on the issue."

Ryan said he would hold a press conference later in the day to discuss the issue further.

Wright, his co-counsel, said it was all part of a deal he and Ryan had offered Cortes' lawyer Anthony Tsontakis before the first hearing where she was forced to testify: i.e., Cortes pulls out and the lawsuit is dropped.

"This morning, they asked if the offer was still open," Wright explained.

Lingering questions remain over state laws allegedly broken in regard to Cortes' candidacy. Was she paid? Who paid for her illegal and insulting "Si, Se Puede" signs? And how could Senator Pearce not know that his family members and supporters were running Cortes as a candidate?

Nevertheless, despite right-wing naysayers who tried to rationalize Cortes' candidacy, such as Espresso Pundit's Greg Patterson, Ryan and Wright have prevailed and prevented a fraud from being further perpetrated on the public. 

They shined a light on the spiders, and the spiders are scurrying.

UPDATE 1:20 PM: Just received an e-mail from Superior Court advising that Friday's hearing has been vacated.

I'm glad to see Mr. Lemons naming names here.  Specifically, Greg Patterson of "Espresso Pundit" and the authors of the Sonoran Alliance blog.  Two of the most popular right wing blogs in Arizona.  Both blogs started by bending over backwards to excuse Pearce's conduct in this affair, or tried to claim that Cortes was legitimate.  Sonoran Alliance ran a piece allegedly written by Ms. Cortes (laugh) that charged "racism" against those who thought she was a sham candidate.  Patterson threw up an enormous cloud of smoke and mirrors.  To no avail.  A fraud is a fraud.  The authors of both blogs are quite often wretchedly racist in their views.  No surprise they love Pearce and will drag themselves through the mud, if necessary, to defend him.

Their latest tactic is to go after Jerry Lewis.  Name calling was to be expected--a RINO, a tool of the radial left, the open borders crowd, big unions, George Soros, I'm sure Hillary Clinton, Monica Lewinski, and the Kenyan in the White House are in the picture somewhere.  Name calling, in this case, isn't good enough for them.  Outright smears will have to be deployed to save Russell Pearce's sorry, cowardly ass from extinction.

The hatchet job involves an allegation that Lewis "stole" items donated to homeless kids.  The charter school where Mr. Lewis is the principal collected a bus load of donated items over the summer.  A disgruntled former employee, who was actually terminated for budgetary reasons, filed a wrongful termination lawsuit.  She alleges that Lewis gave donated items to a friend who sold them at a yard sale.  The school's statement is that many of the donated items were of no use to the school, and that Lewis donated them to a thrift store.  Espresso Pundit and Sonoran Alliance have elevated this to Grand Theft of thousands and perhaps millions of dollars, robbed from poor homeless children no less.  Oh please.

Patterson and the Sonoran Alliance crowd are getting the butts kicked on this one.  Pearce is going down.  And taking them with him.

I just discovered the espresso pundit and the mindlessness that pervades the blog writings and comments is as out there as you can get. They actually believe their own ridiculous lies and can not participate in any dialogue without peppering very statement with logical fallacies. I must take the time to thank Mr. Lemons for his excellent coverage of this whole affair.  I've been absolutely appalled that a creep like Pearce has ended up becoming the most powerful politician in the state.  Lemons keeps shining the light on the dark side of this arrogant, dishonest, hateful racist who rules our state.  The Olivia Cortes affair just exposes Russell Pearce and the people around them for what they are.  And the spiders are still scurrying....

It's actually disappointing that Cortes has dropped out and that the hearing that was to be held tomorrow is off.  Wouldn't it have been fun to see Lester Pearce and the Pearce nieces, as well as Constantin Querard, up there on the witness stand under oath?

Keep shining the light on Russell, Joe, Andy Thomas, Jan, and the rest of the bunch.  Sooner or later, the voters will see the light, and this crowd of racist thugs will no longer run our state.

Unfortunately I came into the Lewis/Pearce debate a half hour late. I have attempted to find a streaming video of the event but it appears that only streaming live is available thus far. If anyone comes up with a link to a streaming recording of the event please post it here.

From watching the second half of the debate, I will say I was very impressed with Lewis's style, composure and platforms. I was also quite surprised at the loud support of pearce fans in the crowd, which it is scary to think that pearce has so many supporters in mesa ld18. Hopefully since the recall effort gathered over half the number of possible voters signatures, the situation will still bode well for Lewis. Lewis was very eloquent, calm, yet with enough force and knowledge of the issues to make a good senator for ld18. Though my main interest is removing pearce from the senate president position and completely out of the senate. Lewis made a good case for his business experienced background to be the best choice for ld18s senator, while painting pearce as the career politician and Lewis did so respectfully and without mudslinging which shows incredible strength and honor on his part. Pearce trotted out more of the same conservative platforms that have done nothing for the state of arizona thus far and kept stroking his own ego for other states following arizonas sb1070 lead. Imho, if you want more of the same crap you have been getting, vote pearce, but if you feel it is time for a change and new blood is necessary as well as being sick of the political payoffs pearce has rec'd, his campaign shenanigans (ie: olivia "the cham" cortes) and the cost arizona has paid for pearces legislation, not just in humiliation and tourist and other revenues but also for the cost of defending sb1070 which I find it hard to believe the supreme court will uphold it all, then a vote for Lewis is absolutely necessary.

Agree with your comment,the only thing I would add is that in the begining the moderator asked the crowd to please hold their applause & cheers. The Lewis supporters showed quite a bit more decorum than the Pearce supporters & adhered to the rules. In the very begining the Lewis supporters were just as vocal if not more than the Pearce supporters. I am curious as to what one heckling pearce supporter was yelling when the moderator told him to shut up. Was anyone able to make out what the heckler was saying ?

That doesn't surprise me as pearce supporters seem to have no problems with breaking rules, which is quite hypocritical considering how much they harp on about the "rule of law."

I hope someone posts a streaming video of the whole proceedings as I would like to find out the other questions asked of the two candidates. The questions were not fluff but also not very probing or anything from pearce we didn't already know.

The AG initially declined to conduct a criminal investigation because there was a civil suit. With that now out of the way, the AG should investigate Cortes' fraudulent candidacy and prosecute if sufficient evidence is found.

Do you suppose if we took up a donation and gave Joe Arpaio a petition from say 300 or so of his constituents, he would look into the possible criminal acts committed here by Pearce's followers?  After all does he not enforce all the laws all the time.  Does he not pay attention when his constituents call him to action?  Is he not the chief law enforcement officer in the county? 

So, if such a petition was given to Arpaio, would he use his awesome power as Sheriff to promptly constitute an Electile Dysfunction Posse?  Or would he just constitute a bowel movement?

Yeah, I posted months ago that as soon as the ballots were printed Cortes was going to withdraw, pearce can not afford the risk of her actually running against him she could win, a remote possibility but a possibility none the less. She served her purpose, and now she will be back in the rat hole she came out of.

What did Russell know, and when did he know it?

Why was Lester Pearce out harassing people with Lewis signs?

Who spent the money on signs?  Who payed the lawyer?  What is Queard and Western, and Oldroid and Grimm's part in this coverup.

Most importantly, Vote out Russell, then indict him, then have the senate expel him, and drive a figurative stake through his heart so that he can never hold another public position again.

Who says her name remains on the ballot?  The Secretary of State?  They don't make decisions for Maricopa County.  If the county has millions to pay judgments against Arpaio's gang, it can afford a minor printing bill.
