Russell Pearce Recall: Judge to Allow New Evidence in Lawsuit Challenging Olivia Cortes

meanpearce999.JPG
Will new evidence directly connect Pearce to the Cortes scandal?

It ain't over till it's over, and the lawsuit challenging the sham recall candidacy of Olivia Cortes ain't over, yet.

Though Maricopa County Superior Court Judge Edward Burke yesterday refused to remove Cortes from the ballot, on Friday at 3:30, he will allow the plaintiff's lawyers, Tom Ryan and H. Michael Wright, to enter new evidence into the record in an attempt to have Burke reconsider his ruling.

Wright told me that he and co-counsel Ryan will call witnesses. Subpoenas and litigation hold letters are going out to several parties, the latter ordering them to preserve evidence. Wright did not want to say who would be subpoenaed until those persons are served.

The witnesses and new evidence will show links between members of the campaign of state Senate President Russell Pearce and Cortes' candidacy, according to Wright.

Asked if he believes that Pearce knew of the Tea Party conspiracy to place Cortes on the ballot as an effort to siphon votes away from Pearce's main rival, Republican Jerry Lewis, Wright said, "Oh, yes."

Pearce has so far denied involvement, though his supporters and family members were directly responsible for Cortes' running and getting her name on the November 8 ballot in Legislative District 18.

The hearing was scheduled after a telephonic conference between the judge and attorneys from both sides in the case. It's the result of an emergency motion filed by Wright and Ryan Monday.

(You can read that motion, here.)

Friday's courtroom action will occur one day after Cortes, Lewis and Pearce are scheduled to appear at a candidates forum sponsored by the Mesa Chamber of Commerce.

They don't even care if Pearce loses on ballots. They will just throw the election and disregard the vote just like NMJ. Stephen - do you remember those 6000 votes Andrew Thomas had in the primary that appeared all at once? It was statistically odd. I think you could do an excellent story using Pierce and MMJ to expose what is happening in our government. There is no way in hades that they will take her off that ballot. You know how they work together and they know the judges.

What is "NMJ" or "MMJ"? And please explain what you are talking about in regards to "if pearce loses on ballots" and throw the election and disregard the vote just like NMJ"? And I don't recall reading about "those 6000 votes AT had in the primary that appeared all at once" so any info or urls point to more info would be appreciated.

Perhaps today is the day when she decides to withdraw from the race.  She has to be having some negative thoughts about the people who talked her into this, and they can't be very positive about babysitting her day and night.  See, e.g., the Ransom of Red Chief.

A debate Thursday?  Another court appearance Friday?  What's the point?  Better to assume martyrdom now.  Probably more votes in that, anyway.

That's why we need to keep up the pressure and make this a front burner issue.  There HAS to be at least a few other people close to her over the years who are trying to get her to step down (at least, if her family cares for her they have to be wise to this by now and don't want the drama ...).  The worse this gets, the more likely those who ACTUALLY care about her can influence her to get out.

Just think of the lifelong embarrassment Olivia Cortes’s family is going to sufferthrough.

If Russell Pearce wins his senate seat it does not guarantee that he will be Senate President again (he is elected to that post by the representatives in the Senate and the other Senators might feel they want someone else in that post).  In addition, at this point, if Pearce does win his seat because of the split of the vote between Lewis and Cortes, it will be equally both Lewis' and Cortes' responsibility.  They both know that the split of the anti-Pearce vote will allow Pearce to be elected (unless they have clear polling to show otherwise).  As such, with that knowledge, they should both be held equally responsible for the persistence of the slime that is Pearce's policies on the State of Arizona.  I know that I will hold him responsible cause I told him this would happen.

My logic is correct.

Cortes is NOT going to remove herself regardless of the consequences of her actions (e.g. Pearce being re-elected).  She understands full well that she will split the Anti-Pearce vote which will allow Pearce to be elected again.  She also understands that if she now bows out, after stating in Court that she is not a sham candidate, that she will be legally liable for contempt charges and probably worse.  She WILL NOT BOW OUT IF LEWIS DOES.  If she does the Judge in the lawsuit would have reasonable standing to order her in contempt as it would be prima faciea evidence that she did intend to defraud the voters.

If Lewis were to remove himself from the ballot now, prior to them being printed, that would leave just two people on the general recall election ballot.  If the supporters of Lewis throw their support behind Cortes, then she will win and Pearce will lose.  He is the better man here and his intention is to remove Pearce.

Regardless of whether he wins or Cortes, that goal will be accomplished.  Perhaps Lewis has a different item on his agenda plate though.  Perhaps that Senate salary and health care looks good right now.

It doesn't matter WHO wins as long as Pearce is removed from the position of Senate President.  If either Lewis or Cortes wins they will be a first term Senator and will not be Senate President anyway.  However, if Pearce wins, it is likely that the Senate will again elect him to be Senate President.  If Pearce were not senate president he would not pose a threat to the rest of us in Arizona as he has been.

BTW - The voters in LD 18 actually don't deserve a good representative.  Being represented by an incompetent ineffective boob, who happens to be a Hispanic woman, is too good for them.  They're the ones who kept electing Pearce to the Senate to represent them.

ExpertShot

I just checked with the Elections Department and the general recall election ballots HAVE NOT been printed.  A few mail in ballots have been printed but not the main batch for the general Recall election.

Cortes and Lewis will split the anti-pearce vote and Pearce WILL win. Don't say I didn't tell you that would happen.

I have been a volunteer for Jerry Lewis and donated money to his campaign.  He is a good man, but he needs to know the truth - he will be held responsible for Pearce's re-election if he doesn't withdraw now.  The idiots in LD18 will not be able to comprehend the complex nature of this election and at least 10% will vote for Cortes.

Lewis and Pearce as presently polling even (according to another poster here).  That 10% of the vote will come from those would would be voting for Lewis.

Again, my logic is flawless - Cortes can not withdraw or she will be found in violation of the law or contempt - either way, she can't withdraw now.  If she does GREAT.  If she is removed by the Judge GREAT - however, the result will be the same if her name is still on the ballot - the idiots in LD18 will re-elect Pearce because of the split vote against him.   That is very simple logic.

I hope I am wrong and a miracle happens and Lewis is elected.  I'm working for that goal.  However, I think my idea is better for getting rid of Pearce as Senate President and a lot more ironic - I mean, think of it LD18, a bastion of white, inbred mormons, being represented by a latina - would that piss off the bigots or WHAT!

BTW - If any question has gone unanswered is was not intended and so the fluck what if I didn't answer it.

First off expertshot... your nick is misleading as your aim has been off again and again.

You patting yourself on the back with "My logic is correct" is no different than cortes attorneys statement that his attempt to stop the hearing on Friday is not a creative legal maneuver.

You have been spanked numerous times previously for your errors in logic and have yet to answer the many pointed questions that reveal the folly of your approach.

The possible outcomes that you paint are no more than conjecture at this point and are hardly the whole situation.

If pearce wins, this is the fault of the citizens of ld18 not cortes or Lewis.

A couple things you are horribly wrong about... that cortes understands full well the ramifications and everything happening to her, I doubt this as thus far she has appeared wholly clueless and didn't understand standard political terms. Second, you paint a situation where Lewis removes himself before ballots are printed... ballots have already been printed and this is one of the major issues of the hearing, where have you been during all this... ah yes way off in left field with your insane political tactics and theories. Just quit now and prevent yourself from appearing further like a fool. You are politically clueless, have very poor logic and debate skills as well as having very little ability to be objective about yourself and your ideas.

Doubtful Cortes will be booted off the ballot. I just hope Pearce comes in a distant third behind his own supporters puppet cadidate Olivia Cortes. I call it Jerry Lewis 95% of the vote Cortes with 4% and the last 1% of the vote to Hateful Lying Cheating Russell Pearce. That would be sooo funny!!!!

Even if Russell Pearce wins the recall which he won't he still loses, even more so.  All things considered the Recall Petition was a call out to Pearce...Resign, ie leave office OR else!  Much like the Corporate request for retirement it's either walk away with a reasonable dignified retirement OR be escorted out by security with your only possessions being your hat and balls (sometimes just your hat). So if he does remain in office the nastiness is going to open up 10 fold.  In a way I see Pearce as the lucky one, among the Arizona Corruption Culture at least, he has been forewarned and given a side door..in the end the rest will not prove so lucky!

To be completely honest, while I do not like him or his stance on immigration, as a fellow human being I am worried about his health.  We need him out of office, but this has to be taking a huge toll on him and I hope he doesn't suffer any serious health event like a heart attack or stroke (b/c if you look at him, he certainly has to be a candidate).  My hope is that in 10 years he walks arm in arm with hispanics in a downtown parade (after having been booted from office and undergoing a huge change of heart).  Hey, many of the southern governors and mayors who were responsible for jim crow-type laws eventually switched sides and joined with their black brothers and sisters in public displays of repentance and good will.  whatever the likelihood of that happening, that should be our hope.  we can't be driven by hate of adversaries ... otherwise we're no better than those driven by hate or fear of other races.  we have to be driven by love and hope.  yeah, i know it sound kumbaya, but seriously, I wish pearce no ill will.  i just want his destructive policies gone and i'd like him out of public life.

If Pearce's supporters and family are signing the paperwork to get Ms. Cortes on the ballot to run against him, does that mean that even his supporters believe that he should be removed from office?  I wonder if they would be willing to promise under oath to vote for Ms. Cortes in the November recall election?

Some extremists are targeting my favorite Arizona legislator, Senate President Russell Pearce, because he sponsored Arizona’s illegal immigration bill SB 1070. Deep pockets on the left are funding a recall effort against him. A more liberal candidate, Jerry Lewis, has been found to run against Pearce in the recall election. A third candidate, Olivia Cortes, has also turned in enough signatures to qualify for the ballot. The recall effort is not really surprising, considering Pearce has become one of the leading mainstream figures in the country opposing illegal immigration. The left sees him as a real threat because he is also personable and well-liked. Even some of his colleagues on the far left like him, such as Rep. Kyrsten Sinema, who is so liberal she once received the Vladimir I. Lenin award from the Arizona Federation of Taxpayers. The recall signatures were collected by a shadowy organization calling itself “Citizens for a Better Arizona.” Its website “About Us” page does not include a single real name, only a vague description. The recall organizer is Randy Parraz, a labor organizer who ran the Arizona AFL-CIO a few years ago and who also worked for the national AFL-CIO for eight years. According to the Huffington Post, “In the fall of 2007, Randy returned to Arizona and began work in the housing industry as a political organizer for the Laborers’ International Union of North America.” Parraz has also worked as a community organizer with Dallas Area Interfaith, an affiliate of the Industrial Areas Foundation (IAF) founded by none other than Saul Alinsky. Parraz started the Student Institute for Social Change, a left wing organization. He ran as a Democrat against Senator John McCain in 2010 and finished last in the race. He co-founded the innocuous sounding “Maricopa Citizens for Safety and Accountability,” which appears to exist solely to bash Sheriff Joe Arpaio. Parraz was arrested in 2008 for disorderly conduct and criminal trespassing due to his conduct protesting Sheriff Arpaio. Afterwards, he turned around and sued the county for $500,000. He cites the Marxist book “Pedagogy of the Oppressed” as one of his favorite books. Since Pearce is Mormon and represents a heavily Mormon populated district, the left purposely sought out a Mormon candidate to run against him. Parraz brazenly admitted to the Arizona Republic that he wanted to find a Mormon who was a Republican to challenge Pearce. Parraz admits the recall isn’t motivated by Latinos angry about SB 1070, stating that most of his volunteers are “white people over the age of 50,” and that most of the people who signed the recall petitions were over age 50. This reveals what most conservatives have suspected all along; the opposition is mostly coming from white, aging hippies. The main candidate being set up to run against Pearce, Jerry Lewis, is careful not to sound too liberal and claims that he is a Republican. But if what he writes on his website is examined closely, it is clear he is no conservative. On the Issues page of his website, he reveals his big government side, “Certainly hard economic times demand that we all tighten our belts and eliminate non-essential spending in an informed manner. However we must not be hostile to local governments in doing so.” Lewis does not take a conservative position on illegal immigration, and uses the language that many open borders proponents use. He writes on his website, “While the federal government fulfills its responsibility to secure the border, I support a rational and fair solution for dealing with immigrants who have committed no crime other than being here without proper documentation. Reasonable, enforceable and sustainable immigration reform must be guided by principles of maintaining national security, respecting all humanity, preserving families, enforcing the rule of law, and weighing economic impact.” He goes on to say that it is the federal government’s responsibility and that we need to move beyond “polarizing, contentious and fear-based rhetoric.” The problem with saying it is the federal government’s responsibility is that the federal government has abdicated its duties in this area. States like Arizona which have the highest rates of illegal immigration in the country have been forced to step up and fill in the void with laws like SB 1070. The left is using classic Saul Alinsky tactics to demonize and smear Pearce. This is no coincidence considering Parraz’s association with Alinsky’s IAF. Those defending Pearce have been viciously attacked online. The left brings up red herrings in order to discredit Pearce, such as diverting attention to whether his campaign signs were improper and threatening lawsuits over it. Pearce is not the only conservative politician in Arizona being attacked for combating illegal immigration with Alinsky tactics. Sheriff Joe Arpaio is constantly under attacks taking the form of investigations and lawsuits, which are trumpeted in the media nonstop, even though most of them never go anywhere. The Arizona State Bar is trying to disbar former Maricopa County Attorney Andrew Thomas, known for his aggressive efforts fighting crime-related illegal immigration. The Maricopa County Republican Party Executive Guidance Committee issued a resolution this month denouncing the Bar’s prosecution, calling it a political witchhunt. The left’s Alinsky strategy to ruin the reputation of conservative politicians against whom they have no real case is to use innuendos. The left-leaning media assists them by making groundless lawsuits front page news and relegating their dismissals to the obituary pages. The left then sues Arizona government claiming abuse from these politicians, demanding millions of dollars from taxpayers, which gets spun in the media as the conservative politicians’ fault for wasting money. Only 7,756 signatures were required to force a recall election, something that was easily accomplished by the paid signature-gathering company. Pearce’s supporters allege that some of the signatures were fraudulent and filed a lawsuit to stop the recall election. The Arizona Supreme Court will consider the challenge this week on September 13. The election is November 8, although early ballots go out October 15 and voters in a race with candidates this starkly different tend to vote right after receiving their ballots. Even if Arizona voters are not thrilled with Pearce for whatever reason, they are not going to turn instead to someone considerably more liberal who was helped into office by the radical left. Pearce is not an “extremist” on the right as the left is trying to portray him. For example, Pearce does not advocate for laws requiring the rounding up and deporting of all illegal immigrants, something that might be considered a more radical position on the right. Despite their deep pockets and Alinsky tactics, it will be tough for the left to defeat Pearce. He easily won election in 2010, and has won elections in his district 16 times. He beat off a challenge recently by Rep. Jeff Flake’s brother-in-law with a 2-to-1 margin. Pearce’s district, located primarily in Mesa, is safely Republican, with 26,000 Republicans, 21,000 Independents and only 18,500 Democrats. No Arizona legislator has ever been successfully recalled. The presence of a third candidate on the ballot will take votes away from Lewis. Pearce has powerful supporters including former Congressman Tom Tancredo and Bay Buchanan, who served as U.S. Treasurer under President Reagan. They haveformed a Committee to Oppose the Recall of Russell Pearce. A Mesa school bond vote that was scheduled to be on the November ballot with Pearce was shelved, reportedly over fear the election would bring out more conservatives to vote for Pearce who would not normally show up to vote against the bonds. Nationwide, 60% of voters support SB 1070. That number is even higher even Arizona, where 70% of voters support SB 1070. One of the principles Pearce always emphasizes is the rule of law. Arizona voters in his district know that selectively not enforcing the law against certain preferred groups of people leads to chaos.

VOrtiz, Tom Tancredo (failed political candidate in his last two attempts) and Bay Buchanan (an appointee with a notorious father) can't vote in District 18. I am a District 18 voter. Why don't you drive around District 18 before you attempt to say that Pearce has support. Lots of Pearce signs...on empty houses with weeds, empty strip malls and lots with chain link fences closing them from public access and many signs in the single yards of avid Pearce supporters. Houses with Lewis signs will vote for Lewis. Houses with Pearce signs? Some will vote for Pearce, others will not because of the distaste they have developed for the man but they don't want to put up with a knock on their door from his brother, the judge, haranguing them for not having a sign put up, so they will vote in private for Lewis. And the houses with no signs? A few weeks back they weren't going to vote. Today, they will vote Lewis. That is just the Republicans. I wonder where the independents and democrats stand? (lol) VOrtiz...go take care of business because your favorite senator is truly "running scared." I have awarded Pearce the "2011 Most disingenuous senator" award. This can accompany his laughable "2011 Silver Apple Award" from a teeny, tiny parents of homeschooled children in Yuma. Where are the endorsements from the District 18 public schools and public school teachers?....crickets chirping... Endorsements from Mesa's civic leaders?...more crickets chirping... Endorsements from established Church leadership? ...more crickets chirping...  So I ask? Are there enough hate-filled, radicals in District 18 to keep Pearce in office? Enough with Tea Party affiliation? Enough illiterate ignoramuses? I don't think so...

Let's change the face Mesa's politics! Vote Lewis.

Ahhh ,vortiz is just a cut and paster of typical unsubstantiated right wing political propaganda or this is rachel alexander, the one whose license to practice law is close to being suspended for her role in the whole sordid andrew thomas affair and the original author of most if not all of this post. If read closely this unattributed and most likely plagiarized work reveals its origins by pointing out dates in a language that shows the date has already passed weeks ago And vortiz was to stupid to read what he is posting and make appropriate corrections so the article would be up to date. As it stands it is a few weeks old and doesn't take into account all that has been learned about the unethical shenanigans of pearce's supporters as well as how thoroughly thomas, aubuchon and alexander are getting their asses kicked in the BAR hearings. Google any sentence and the truth is revealed. Pearce supporters have no concept of what ethical is and will break the law whenever it suits them which is moronically hypocritical considering they are all big on pearce's lies that he is for "the rule of law."

I doubt rachel would use a nick here when she has posted this article online under her own name already. If this was college you would be expelled for plagiarism. Sad that we do not acceot such behavior from college students but it is a-ok by pearce supporters. Fortunately many of us who find pearce a joke and undeserving of any position of power are in the three digit IQ range while pearce supporters reside in the double digits easily.

Try writing something your self and then maybe I will read it all the way through. Once again a pearce supporter makes pearce and his supporters appear moronic as ever.

Where are Candy Andy and Shurf Joe now that they are needed? They could put a stop to this be making up charges and arresting everybody opposed to Pearce.

Let's see...

Candy Andy is too chickenshit to show up at his own disbarment hearings, even though I'd like to see him there, even if he has to be dragged there in chains kicking and screaming like the 4-year-old that he is. So I highly doubt that the coward would bother to arrest all of Pearce's foes. Let's not forget that Candy Andy is a subject to the DOJ abuse of power.

As for the Flaccid Fool of MCSO...

He's probably even more scared than Pearce right now because the state and the feds are closing in on him and are thisclose to issuing some indictments listing some very serious charges. So, as a result, the MCSO shurf is probably looking over his shoulder worrying that at any minute, agents from the state and the DOJ will come to his house over in Fountain Hills and take him and Ava into custody. Then, the Old Fool will be perp-walked on all the news channels (and I will be recording it live).

Only if they can produce evidence that Cortes (probably in writing) said that she was aware she was a sham candidate in the race to ensure Pearce won will the ruling be overturned.  It doesn't really matter what Russell knew, because Cortes seems to have been duped (at least, she has effectively portrayed herself this way).  However, if there is correspondence between people that says, "I talked to Olivia, she's in and she's going to be our plant" that would be a contemporaneous memorandum that would outweigh her testimony.  I HOPE they have that.  Anything short of what I outlined above, she stays on the ballot.

That being said, if Cortes gets tied directly to Pearce, the ads write themselves.  (WE all KNOW it is tied to him, but when we get his direct fingerprints on this, it can be used to completely puncture his narrative that he knew nothing).

So there's a less-likely big win, and a more-likely small win here.

Either way, there's nothing to be lost by driving this train forward ...

AZGregory
AZGregory

The most obvious evidence that she is and always was intended solely as a sham candidate, and knew it, is that she turned down several people who offered to volunteer for her. There are numerous reports of people who contacted her, including one hispanic woman, and asked if she needed volunteers as soon as she filed papers to file. She said curtly no thanks I don't need any volunteers.  In my mind, no one who actually and honestly hopes to win or even run a real campaign categorically declines any help from potential volunteers. From the interviews published to date, it is clear that she is not a bright woman and has been duped by the Pearce supporters but I don't see any conceivable possibility that she is being truthful when she says she is in it to win. Remember virtually everything that was done to make her look like a viable candidate, no matter how laughable those efforts were, all came after the media started piling onto the story and/or after the suit to challenge her. I think she was scared that she was going to face criminal charges and so the strategic decision was made by her puppetmasters that one way to win the suit was to create the trappings of an actual campaign and candidacy. It looks like the original plan was just to get her name on the ballot and put up a few misleading signs in Spanish.  Fortunately, this fiasco has proven the level of ethical depravity of the East Party Tea Party and Russell Pearce's closest supporters/family while at the same time proving how stupid and incompetent they are.  Prediction:  The Tea Party in AZ will be the gift that keeps on giving and they will provide us with many more dopey, ill-conceived political shenanigans until they become enough of a liability that local Republican candidates ignore them.

It doesn't matter, she's on the ballot, a Judge said she was a valid candidate and unless they appeal to a higher court, that's the decision.  The point of the whole recall was to remove Russell Pearce as Senate President.  The point was NOT to remove him as senator for LD18.  No one filed recall petitions on him until he started having enough power to actually get his initiatives passed.  Whether Lewis or Cortes wins is not the issue - if they lose, Pearce will remain senate president.  I don't give a hoot if LD18 has effective representation or not - Lewis or Cortes, either one will do.  But if both stay on the ballot, Pearce WILL win.  Certainly he will have a greatly increased chance of winning.  Jerry Lewis should bow out NOW!!!!  He should do so while this issue is still before the courts and if Cortes also bows out the Court can call the election fraudulent because of the tea party actions in getting Cortes on the ballot.   If she stays in she will win.  In a one-on-one race it will be close but in a three-way it will be hands down Pearce.  Keep your eye on the prize - removing Pearce as Senate President.

DearExpertShot:

"The point was NOT to remove him [Pearce] assenator for LD18." This is incorrect. On the contrary, this was theprecise objective of the recall: to remove my state senator from office andhold him accountable for his corrupt practices and inability to craftlegislation that improves the lives of people in our district. Now, you may notcare whether our constituency has effective representation, but I and 10,000 other people care a whole lot.

Furthermore, Cortes has no political platform, does notcampaign, does not wish to speak to constituents, dodges the media wheneverpossible, and her testimony last week revealed that she lacks basic knowledgeand oversight of her own state senate campaign, e.g., who paid for campaignsigns, why her campaign’s advertised phone number rings directly to the GOPoperative running Pearce’s re-election campaign, etc., etc. In my eyes, hercandidacy is a deceitful Tea Party election heist. The choice is clear: VoteJerry Lewis if you believe both Mesa and Arizona deserve competent leadership!

Not true, Shooter. The purpose of the Recall Pearce campaign, from day one, was to remove him completely from office. He just happened to be senate president at the time and was in a position to direct bad things to happen statewide. That, in and of itself, is probably what made the recall effort the HUGE success that it is. Once folks realized how little he was doing for the good of LD-18, and how much damage he was trying to do statewide, they decided it was past time to move him OUT of office.

You apparently haven't yet realized that pearce has been recalled and his last official day in office will be after he has lost his bid to be elected to his senate seat. You see, Shooter, he has been removed from office and he is running against Mr. Lewis for the seat he once held. Olivia, of course, is just another name on the ballot.

Mr. Lewis will win the seat, and very likely will one day be senate president, as well.

You may shoot far, but you don't seem to shoot straight.., Expert.

I'm going to stick with my initial analysis.  He's being recalled solely because he was Senate President.  If he after he gets re-elected to office through this  recall, and resigns as new Senate President or a new Senator is elected by the Senate to the office of Senate President and another recall is not attempted, we will know the truth.  However, until then - we'll both have our opinions. If the voters of LD18 were opposed to Pearce so much that they wanted him out, as their Senator, in a recall now, why did they elect him to four term as their Senator?  Why did they only want to recall him now, that he was Senate President and was directing all his bogus bills that he couldn't get passed before he was Senate President.  No, Tommy, I think that because he was such a bad actor before he was Senate President didn't matter a twit to the voters of LD18 - in fact they obviously liked it.  They elected him FOUR TIMES.It was only the fact that he became Senate President and was directing bills to pass that were WAY OFF THE CHART ethically that they recalled him - and truthfully, it was instigated by others, not in that legislative district.  I agree with the recall and want him out as Senate President.  Actually removing him from office as the senate representative of LD18's residents - ehh, I could give a shit who represents those bucktooth rednecks.I do think it would be the ultimate irony though if their sham candidate actually thought she was for real and won in a head up race between her and Pearce (Lewis having dropped out before the general recall election ballots were printed).  I frankly don't want that LD to have a good representative, conservative or not - they don't deserve it for the crap they've pulled on our state by electing this gumba!

Horribly bad idea.  Right now polling is 34-34 Pearce Lewis, with 26 undecided and 8 Cortes.  the focus should be on taking Cortes 8% down to 0% through educating that part of the electorate that has been duped.  Those votes will move to Lewis.  I also suspect that if the 26 undecidedes have had Pearce for 10 years and still aren't sure he's their guy, what they're really saying is "I'm not voting Pearce but I don't know enough about the other candidates yet".  Assume those break about the same ratio as Lewis-Cortes is breaking now and you've got Lewis by a long way ...

Pearce's cieling is where he sits right now.  Lewis's floor is where he is right now.

Pearce is in real trouble.  This is a district that is 60% republican.  Let's assume ALL his support is from Rs, and it becomes clear that he's barely getting half of the Rs on his side.

If Cortes doesn't drop out or Lewis doesn't drop out, I do hope Lewis wins.  However, I don't think this will be likely.  That is why I suggested this tactic in this election - because it's logical and the only way we can get Pearce out as Senate President.  BTW - I am a bonifide member of the coffee party.

Again here is ExpertShot trying to get the real threat to Pearce to drop out.  Please! You are either one of Pearce's family members or a tea party nut who thinks wewould be stupid enough to fall for that.  Give it up.  We will vote for Lewis butnice try.

If you're right, then I'm fine with Lewis staying in the race.  But if you're wrong and all of a sudden Queerard starts some kind of PR campaign on behalf of Ms. Cortes, this whole thing could backfire.  Having Pearce claim to have survived a recall would be a tremendous blow to our progressive attempts to improve this State's image and policies.  I think it's much to big of a risk to continue with three people on the ballot.  Dump Pierce should be the rallying cry, not elect Lewis or elect Cortes.  With Lewis having no skin in the game and Cortes risking charges should she withdraw, I say,  Mr. Lewis - bow out and put your support behind Ms. Cortes!

Hmmm...

Is there a statute or ruling that states pearce will remain senate president even though he has been removed as ld18s senator?

The lawsuit has yet to be concluded and there is as yet is no final decision as evidence is still allowed to be presented, why do characterize the situation otherwise?

Why should Lewis bow out now since cortes most likely will not back out otherwise this would prove she knew she was a sham all along? Cortes has to stay in the game until the end now that she has feigned ignorance of pearce supporters machinations.

What difference would having Lewis and cortes bow out now affect the possibility and outcome if pearce wins regarding calling the election fraudulent?

How are you so sure if cortes stays in and Lewis backs out that she will win over pearce?

How are you so sure that if cortes backs out pearce would win. This seems to contradict your point about cortes winning if Lewis backs out.

You are not making a lot of sense to me since you do not back any of your statements up with facts.

My point exactly - the jackass voters in LD18 deserve Olivia Cortes - they voted for Pearce SIX TIMES!

Have you seen an interview with Olivia Cortes? Obviously not if you keep suggesting voting for her. She isn't a viable candidate. She isn't a viable anything. She can't even remember whether she is for or against something. Doesn't know anything. But she isn't a "Cham" candidate. Your parents should sue the babysitter for dropping you on your head one to many times.

Hahahaha! You had me spitting my tea out my nose. After over two decades of debating and flaming on the net, yeah I was accessing usenet via a bbs as early as 1990, your accusation that I was letting my emotions get the best of me is hilarious. Fyi, I learned long long ago to approach internet debates/arguments, etc as emotionless as possible, reaching near perfect states of emotional detachment as possible gained through years of practising meditation and emotional detachment. Which is why I perform very well under extreme stress including emergency and possibly fatal situations. If I can keep my sh*t together and think clearly after being kidnapped and having a loaded shotgun aimed within inches of my face, I think I can divorce myself from my emotions when analyzing and coming to conclusions as to what I think is the best manner in which to approach this situation. If anything you appear guilty of projection and guilty of the very thing you accuse me of. Man, you are just too much.

But getting to the point, cortez is not going to win and the best and most logical bet is to support Lewis even if you are not a resident of ld18 because as we both agree on, removing pearce as the senate president is the ultimate goal of us who are not represented directly by pearce.

Cortes does not have the ability to represent district ld18. Cortes has proven she has little grasp of political vernacular, zero oratory skills and a bare minimum grasp of the English language. Besides her almost unintelligable speech that was subtitled on at least one news broadcast.

If you want to help pearce lose, contact Lewis's campaign and volunteer to help, that kind of action has the highest probability and odds of helping Lewis win and pearce lose.

Heh, so I had it right the first time unintentionally. Thanks for the correction and info. This point you bring up here and something I read elsewhere have illuminated me to the fact that pearce no longer holds his senate seat and has to reclaim it through the recall election, if I am understanding it all correctly.

G23, technically he is no longer filling that seat. He was sent a letter advising him of the recall results (I believe generated by the Secretary of State) and his options, which are (1) submit a letter of resignation immediately, or (2) face an election to reclaim your seat. He chose option (2), of course, stating he would NEVER resign from the seat (He's always been fired, you see). Then Mrs. Brewer did her governorness job and sent him a letter advising him he would have to face election, to be held on November 8th. He, of course, appealed the recall results, saying, "The law is on my side and I expect the judge to see it that way". Then he lost the appeal. Rule of Law can be such a bummer when judges actually see it differently...

It doesn't matter whether Lewis or Cortes beats Pearce, just so long as someone does.  The idea is to remove Pearce as Senate President.  If he is no longer a senator, he will no longer be able to be Senate President.  Cortes is stuck - let her be the senator from LD18 - what do I care who is the senator, as long as Pearce is not in a position to embarass this State any more.  That should be the prime directive here - not that we get Lewis or Cortes in - dumping Pearce.   Now, if Lewis has something more than that to gain, then he will stay in and probably loose.  In any case, you are right, Cortes can't pull out now because she will probably be found guilty of defrauding the voters.  Lewis shouldn't have any skin in the game though.  He probably did this thinking that he would help out.  Well, he's not helping out now - he's splitting the Anti-Pearce vote with Cortes.  I agree that he would be a better representative for LD 18 but he will only be a freshman and frankly I think the voters of LD18 deserve a Latina in the Senate.  You're using your emotions rather than your brain and that's why what you read of my ideas is not making sense.  Just remember the prime directive - dumping Pearce from the presidency of the Senate and it will all be clear.

The first paragraph should read "if he is removed as ld18's senator." Rather than "he has been removed..."
