Russell Pearce Denied: AG's Office Says No Corporate Contributions for Pearce's Anti-Recall Committee

More bad news for state Senate President Russell Pearce.

One day before the historic announcement by the Arizona Secretary of State's Office that the Pearce recall will go before the voters of Legislative District 18, Arizona Solicitor General David Cole informed Pearce that recall committees cannot accept corporate or union contributions.

Cole also shot down an attempt by Pearce to penalize Citizens for a Better Arizona

Pearce and his lawyer had asserted that the pro-recall committee had to abide by the same financial reporting guidelines as ballot measure committees.

The Solicitor General advised Pearce that state law doesn't back up that contention. You can read Cole's opinion, written on behalf of the Arizona Attorney General's Office, here.

Pearce's lawyer Lisa Hauser had made the same arguments to State Elections Director Amy Bjelland, who in turn, rejected those arguments

Following this, Pearce penned a missive to Attorney General Tom Horne on Legislative letterhead, asking for an opinion on both issues regarding Pearce's dire straits. (Horne recused himself from the matter, passing it off to Cole, who was appointed by Horne.)

And of course, Pearce was denied. What is it about the law that he doesn't understand?

However, the opinion from Cole contained a concession of sorts.

He pointed out that because of the U.S. Supreme Court's notorious Citizens United ruling, "a corporation or union cannot be prevented from making donations to a recall committee that does not coordinate with an individual who intends to run for the targeted office."

Which means independent expenditure committees can take corporate or union funds, as long as there is no communication between that committee or the candidate.

What good that does Pearce is debatable. Pearce is a puppet of corporate and out-of-state special interests, and these groups will rally to his defense and likely spend money to the extent it's allowed by state law.

But even the political hacks working with Pearce to challenge the recall have conceded that this campaign will require old fashioned door-to-door politicking. And Pearce will have to expend some shoe leather himself, something he has not had to do in many a moon.

All the signs and fliers and TV ads in the world will not guarantee him victory. Sure, all that may help him, but this is not some statewide or even countywide race. It's Pearce's own backyard, his own Mesa sandbox. 

And if he cannot convince his neighbors to go to the polls for him on a day when there will be no other reason to do so 'cept for the recall, he is doomed. Even if the other name on the ballot is Mickey Mouse.

Pearce was fired from MCSO because he was considering running for Sheriff and Arpaio wouldn't have that. Pearce and Arpaio were not pals until a few years back when Arpaio jumped on the anti-immigrant bandwagon.  Pearce would still like that gig. Unfortunately, the most powerful person in this State is the Sheriff of Maricopa County. Arpaio has proven it. He interprets the law as it suits his personal agenda and enforces it as it suits him. Thats more power then any politician has at their fingertips. The Feds seem uninterested in stopping him and by not doing so have encouraged other Law Enforcement to abuse their power and scape-goat anyone they choose with brown skin for any reason.

Reading in the Arizona Republic this morning there were 2 articles of interest concerning the voting rights and how they are bastardized in this state...specifically.  One article concerned "individual donations".  The other concerned "VOTING CENTERS" which would give the voters access to ballots and information concerning THEIR local candidates.  Evidently 15 million dollars is too much to help the voters better it be given to assholes like Pearce, Arpiaio, Thomas and the rest of the Corrupt politicians in this county.

Stephen, thanks for filling us in on this.  I'd remembered that Horne said he'd have an opinion in about a month and was wondering about it.  I haven't read Solicitor General Cole's response itself, but your summary of it looks like it's very well reasoned.....as was the previous response by State Elections Director Amy Bjelland.  That 5-page "request" by Russell Pearce (written by Hauser) to Horne was a bunch of twisted gobbledy-gook.  It wasn't  really in search of a genuine legal opinion, but was in search of an affirmation of Pearce's desires to be able to accept corporate and union campaign donations, since he's already said he won't resign after having been recalled, and wants his name to appear on the election's  November ballot.Thanks again for the information.

We folks of normal logic don't understand, so I went to Grand Avenue and sought out a soothsayer, hoping she might understand and be able to help us, since she claims to understand most things about to happen:

After all the bullshit that Thomas, Aubuchon, Arpaio and Hendershott put Donahoe through, I find it absurdly laughable that the Judge would resign over a $200 contribution to Horne's opponent.  The bitch is a certifiable nut job.  I hope Donahoe goes after her for that article.  Back when Candy Andy was trying to figure out what bribe Donahoe alledgedly accepted ("If I'm not explaining this well, I hope you will help me" - LOL!) the biggest question mark was that Donahoe had already announced his plans to retire and would not even be a sitting judge when the Court Tower was completed.  Bently's one twisted twat to think that this is anything other than a planned retirement, and I hope someone can start holding her feet to the fire about her scandalous rehtoric!!
