Russell Pearce's Son Joshua Out of Stir, Josh's Wife Files for Divorce

To read recent accounts of state Senate President Russell Pearce's lawbreaking son Joshua Pearce, you'd think he'd only caught six days in stir for violating terms of his probation on a 2007 aggravated DUI conviction.

In reality, Pearce the Younger had already spent close to two months in Sheriff Joe Arpaio's gray bar hotel before a judge ruled on his case in a March 30 probation revocation hearing. He was arrested way back on February 9.

This prodigal (and criminal) son had been facing serious time in the state pen, but he basically cut a deal, admitted to the probation violation, and earned another six days in county before being released this week. The judge fined him more $3,700, and tacked on 30 hours of community service.

Senate President Pearce did not come to the aid of his wayward offspring. A public defender was Joshua's attorney, meaning that the taxpayers picked up the tab for Joshua's defense.

The probation violation report on record with the court described the series of events that landed Pearce in the hoosegow. 

It states that "since his placement on probation it appears the defendant has struggled with prescription drug use and has entered detoxification programs on several occasions."

Further down, it notes that, "Results from a drug test submitted on December 10, 2010 showed the defendant testing positive for methadone and morphine, which he failed to disclose or provide a valid prescription."

Then Josh missed a January 26 court date for a mental health review. The report states that Josh told his parole officer, "he was considering revoking his probation grant and serving his time in the Department of Corrections."

When he missed the court date, he left "a voice message indicating he was in the hospital."

His failure to appear triggered the bench warrant that got him pinched.

Josh has had numerous run-ins with the law, and was recently investigated for possible child abuse in a December incident that left his infant daughter hospitalized with a skull fracture.

The child's injury occurred on December 10, the same day the failed drug test was submitted. Officers who interviewed Joshua on that day described him as groggy, lethargic and smelling of alcohol. Josh admitted to being on Xanax and Percocet.

Though Mesa investigators believed Josh was not being truthful to them about the newborn falling out of a "bouncy chair," they declined to seek prosecution for lack of evidence

Josh's drug use has been well documented in other encounters with Mesa law enforcement. In the DUI that earned him the 2007 conviction and five years probation, he had his infant son in the car with him. Regarding his pot use, he told the cop that he liked to "wake and bake." 

In a 2005 incident where he got into a fight with two men and fled police in his car, officers found a pipe with residue. Josh admitted to arresting officers that "he smokes as much marijuana as he can get." He had a bac of 0.15 and tested positive for THC. 

On January 25, Josh's wife of three years, Samantha Pearce, filed for divorce, seeking sole of their three children. 

Not surprisingly, she's requested that Josh's parenting time be supervised because of Josh's "over medication, addiction/dependency."

And this is news, why?

If anything is demonstrates that Pearce is true to his word: he is a law and order guy who thinks so little of those who commit crime that he will even abandon his flesh and blood before he will abandon his principles.

I have to wonder, if Pearce were a democrat, would he get the same treatment? Given the long history of the PNT trying desperately - and failing spectacularly - to see Pearce defeated in free and fair elections, it seems likely that politics and not newsworthiness is driving these reports.

Everyone thinks the son is a tool, and as the PNT reports "Senate President Pearce did not come to the aid of his wayward offspring."

So, where's the beef?

So many legitimate reasons to go after Pearce. Witnessing the PNT dive into the gutter with reportage such as this simply eviscerates its credibility when reporting on Pearce, thereby effectively muting any negative press of the senate president.

This is news because

The Republic's notably "light on facts" article failed to mention alot of critical facts. (One wonders, why? Who benefits? A favor to whom?)

Josh Pearce tested positive for substance abuse while on probation, but didn't get put in jail. The very same day, and by his own account and all the witnesses, he was the only with his 9 day old baby and was capable of causing her injury, a fractured skull. But he didn't get put in jail. Mesa PD department despite their own investigation with incriminating evidence, has declined to press child abuse charges. Unheard of!

He wasn't picked up for almost 2 months after failing a drug test. Unheard of! He finally gets to court, and is he sent back to prison? No! Unheard of! He pulls only 6 more days in jail, a fine (which he has no capacity to pay) and a few more community service hours.

Please, spare me the "Pearce didn't pull any strings to help his son" line. Had this been any other guy, he'd have been back in jail right after the failed drug test. Maybe then his daughter would have been spared a fractured skull inflicted on her at the age of 9 days old. And that Josh Pearce hasn't been charged with causing this injury is outrageous! Don't tell me Daddy and/or his "friends" haven't been managing things here. A 9 day old baby had her skull fractured by her drugged out father...when is there going to be justice for her? When is her abuser going to be held accountable for his actions?

And as to how this speaks to Russell Pearce. There's documented history of domestic violence by him on his wife. His son's history speaks clearly that this learned behavior is continuing and being exacted upon another generation of the family.

His infant son, a girlfriend, his girlfriend's (now wife) 2 year old son, a couple of guys in a bar, now his 9 day old daughter, who's next? Who's going to cry foul when he hurts someone again? Who's going to look back at this guy's history and see that measures that normally would have been taken, weren't?

And again, the lack of accountability and consequences for Josh Pearce speak volumes about political influence.

It's pretty pathetic when you fall back on the hackneyed argument that "the best evidence we have of his guilt is the complete absence of any evidence."

Josh was treated like every other dirtbag I've witnessed in my career, getting exactly the treatment you or I or our family would receive. Anything claim otherwise is a lie born in unbridled hate.

There are so many good reasons to attack Pearce! Why waste your credibility and your honor making up lies and engaging in base personal attacks.

Joshua is feeling the consequences and is being held accountable for his acts. So to are you: the more lies you tell the easier it is for Pearce's apologist to shoo away anything you write or say - even about legitimate issues - as the ramblings of a loon.

So, which do you choose: the selfish mental masturbation that comes with lying, or reserving your righteous anger on issues that are demonstratively true and that can turn elections and public opinion?

I am not a fan of Pearce, and yet your actions place me in the uncomfortable position of being his defender. Can you imagine what an previously neutral reader must think of you at this point?

Your responses show you have no idea of what happens in our probation system and courtrooms everyday, or you are just posturing.

I've dealt with employing guys from halfway houses who have had similar backgrounds...they can get yanked in (to jail) if they so much as miss a phone call.

Any other guy with Josh Pearce's history would have faced severe consequences. Any other guy with similar circumstances would have been jailed immediately after a failed drug test, or after an investigation clearly pointing to him as the abuser of his 9 day old baby, after multiple probation violations...he'd have gone back to prison in the everyday world of our justice system.

Consequences, what consequences? Six more days in jail, a $3700 fine, of which he has no personal capacity to pay, and 30 hours additional community service? Those are are not consequences at this point in his accumulated history of drug use, extreme DUI, physical violence, and domestic abuse. And where is the justice for his baby who had her skull fractured at 9 days old?

You can make your attacks all you like, but like Grandma always said "Eventually it all comes out in the wash."

The future will prove one of us correct, and for the sake of future victims, I do hope I'm proved wrong.

Do you have any proof that Joshua was given special treatment?

Any? At all? Even one single hint of evidence?

For those unfamiliar with the AZ justice system it is tempting to think the timeline seems off. However, if you have any exposure or experience with the system, for whatever reason, then you immediately recognize Joshua was treated just like any other dirtbag.

Ask any cop, ask any lawyer. Or, just trust that given the hate Lemons holds for Pearce, that if there was even a smell of special treatment, he would run it big and bold and in hyperbolic terms.

Lemons offers no proof of special treatment because, it seems, no special treatment was given. Which again begs the question: why is this news?

Given your made-from-whole-cloth assertion that Pearce pulled strings, in the absence of any proof whatsoever, you become just another voice that the middle-road Arizonians will ignore. Come on - how can anyone trust you to speak the truth about the things Pearce is actually doing wrong when you can't speak truthfully about his family?

If I can't trust you on the small stuff, I'm not going to trust you on the major issues. (Are you reading this, PNT editors?)

If there were smoke here, that Joshua received special treatment, the PNT would run wide open on it. Because there is no smoke, and thereby no proof of a fire, the PNT trafficked in inuendo hoping that lazy minded readers would assume something happened.

At the end of the day the goal of this article is not to inform the public with important or entertaining information, it is to move forward the political agenda of the author. Lemons is no differant than Pearce or Arpaio in this regard: what ever tools he has to cause harm to his political enemies he will use, with no regard to the ethical considerations therein.

Lemons is a highly-skilled columnists and an asset to the paper as well as the community. However, he is wrong to use the sins of the son against the father. It is a breach of contemporary journalistic ethics to go after the children of public figures and it ultimately harms the larger issue - nay, the larger need - of ousting Pearce from office.

Apparently anything short of camera evidence with audio of Pearce telling an officer to go easy on his son isn't enough for you to be convinced that strings are being pulled to get this mini Nazi off with a series of wrist slaps.

PROOF isn't needed here. PROOF is rarely needed anywhere. There's OVERWHELMING EVIDENCE that he's been getting preferential treatment by the cops in Mesa (where his father is the de facto boss). Put two and two together to figure out why, genius.

He's been arrested, what, eleven times now and he's the only person that could have possibly had anything to do with the baby having her skull fractured. And yet a quick investigation shows that there's not enough evidence to proceed.

If this were me, you or anyone else sans Jan Brewer's son we'd be in prison right now.

Actually, this article wasn't the root cause of my statements...it was the Republic's article and it's noticeable lack of all the facts.

My concern here is not Russell Pearce, my concern is that Josh Pearce got a really really good deal in terms of his history, his probation, and his violations. My concern is that he hasn't been held accountable for his 9 day old daughter being inflicted with a skull fracture while in his care.

Any really, if Russell and Josh Pearce's history of domestic violence were to affect any "political" agendas...I think it would have already happened.

It is sad that domestic violence seems to have been accepted in Pearce's case. I guess if it takes PNT/Lemons/"Yellow Journalism" to bring some attention to this, I'm okay with it. Domestic violence is not acceptable in any circumstances.

Thank God there is at least ONE young woman out there that cares enough about her children to protect them and get them away from a father (or father-figure / boyfriend) who has demonstrated a lack of ability to be a caring, loving, nurturing parent. Hopefully the kids will have a happy, healthy life in spite of their father's issues. I think we see stories daily where this is not the case and so many babies for whom it's too late.

I'm afraid this has all the markings of a future story of death of a child by a live-in boyfriend who is baby sitting while the mother is at work to support all of them. The biological father is in prison, or has died from an overdose, and doesn't contribute financially or emotionally to the children.... The rest of the children are taken from the mother and become wards of the state. ALL of them are given free medical services and housing. Yet, they are all citizens and not considered brown or illegal. In the mean time the biological grandfather is busy out in public showing how important he thinks he is, trying to convince folks to get rid of all them damn illegals who are stealing jobs and sucking off the free medical services our nation offers...

Unfortunately, we may be reading this story sooner than later....

My advise to Samantha, run baby, run. As far as you can, definitely out of the states of Arizona and Utah. Don't look back.

Chalk this all up to an expensive learning lesson, but make sure you keep the hard learned lesson(s) close to your heart, and in your head. When you meet a guy, if he doesn't treat you and your kids like angels, he's the wrong guy...dump him and move on.You and your kids deserve and are worthy of the best kind of a man, nothing less.

Stacy why Utah? What's so bad about Utah? Because of the Mormon population there? I have lived in Utah for 12 years and to be honest, it wasn't as wacked and fucked-up as it is here. In fact, I find most Mormons are quite moderate and rationale. I have come to know that Mormons are some of the friendlest people I've ever met. The Pearce types are quite small and insignificant. I would say that there are more "Chad Snows" up there than Russell Pearces.

My adivice to Samantha is to gain full legal custody of her children and cut off ties to the atrocious Pearce family and move on.
