Joe Arpaio Victim Scores $30K for False Arrest

As Sheriff Joe Arpaio tosses cots in Tent City with Steven Seagal, a woman in Guadalupe, Arizona is looking forward to a check cut by the county for $30,000. This, due to her false arrest and imprisonment at the hands of Sheriff Joe's boys in beige.

You may recall the name Elaine Sanchez from a March 2009 feature by Village Voice Media Executive Editor Michael Lacey, "Are Your Papers in Order?" That piece told the story of the Sanchez family, and how they'd been targeted for harassment by the Maricopa County Sheriff's Office, which provides police services to the little town of Guadalupe.

The article also kicked off a series documenting incidents of racial profiling in Maricopa County, telling the stories of those who had been profiled.

Lacey lays out the details of Sanchez's 2008 run-in with MCSO deputies, thus:

Tracked for nearly a mile by Sheriff Joe Arpaio's deputies last May, when the Dodge still ran, Elaine became alarmed, and then terrified, as the lawmen followed closely without ever turning on their lights. Her anxiety surpassed anything associated with an ordinary ticket; her family had already exchanged tales about this sort of enforcement.

Elaine drove the van into her backyard. After banging on the back door and screaming for her own mother, she was wrestled to the ground by the sheriff's men. Sanchez's boys emerged from their home to find their mother flat in the dirt with a deputy's knee in her back as she was roughly handcuffed.

The light over her license plate was out.

Sheriff's deputies actually made a U-turn to follow her. That is, before they could even see her back license plate. Sanchez was not cited for the dead license plate light, though. Instead, she was hit with a disorderly conduct charge. She was processed at the Guadalupe substation and subsequently released.

The charge? It was dismissed, of course. MCSO deputies had arrested her, and held her prisoner without probable cause. Not to mention roughing her up in the process.

Phoenix attorney Danny Ortega took up the case and filed a notice of claim with the county for $135,000, citing false arrest and imprisonment, malicious prosecution, assault and battery, gross negligence and violations of federal law and the Arizona Constitution. 

In 2009, Ortega brought suit in federal court against the county, Joe Arpaio, the sheriff's office, and the deputies involved. On March 2 of this year, the county settled for $30,000.

"I was glad we were able to achieve a settlement," Ortega told me. "It shows there are consequences for police misconduct."

Not that such settlements stop the MCSO's bullying of brown folk, which is infamous in Guadalupe and elsewhere. I can't help but recall the infamous April 2008 sweep of Guadalupe, where black and gold MCSO vehicles were everywhere, hunting "illegals" in a town where almost everyone's family has lived there for generations.

The MCSO even went so far as to menace a confirmation ceremony for the town's children, scaring away some who feared the sheriff's wrath.

The us-them mentality continues to this day, though there are some augurs of change. Elaine Sanchez's brother Andrew, is a community activist who has followed MCSO vehicles to videotape their activities. He's currently seeking a seat on the Guadalupe town council. An initial "primary" election was held this Tuesday.

Though he was one of three persons vying for three open seats, none of the candidates won a seat outright this round because none of them garnered the 50-plus percent required. But there's another election scheduled, and Andrew Sanchez told me he's not giving up.

The idea that Andrew, a man who has consistently opposed Arpaio's iron rule in Guadalupe and has suffered retribution as a result, may one day sit on the town council, is an exciting prospect.

It's something to look forward to, almost as much as his sister Elaine getting to cash her $30,000 check.

You'd be surprised the number of lefty, ethnocentric blogs that are claiming that Arpaio was convicted of racial profiling in this case when he wasn't nor has he ever been. He was convicted for false arrest. But then these advocates (anti-American traitors) always make things up as they go along to fit their agenda. Sanchez and her brother had already obstructed justice by warning illegal aliens when the MC officials were in town and making deragatory signs. Of course, loyal, law abiding Americans should be siding with illegal aliens instead of the law, right?

Yes, police can pull you over for having a license plate light out. I was pulled over about 7 years ago for having a tinted license plate cover. In Snottsdale. Petty, yeah but I paid the fine and went on my way and now I will never use a tinted license plate cover again. Mexicans bring the heat on themselves. If they would just come here legally and if mexicans who are actually US citizens would back bills liek SB1070 instead of opposing them and defending criminals/illegals then there wouldn't be these kinds of problems. Now for the rest of the story. Sanchez and her brother already had altercations with the MCCSD. They were obstructing justice by warning illegal aliens when they were in town. They made signs demonizing them for all to see.

Where are the racial profiling charges in the attorney's accusations? There were none as you can plainly see. So why spin it that way? $30,000 is a far cry from the $135,000 asked for in the judgement. By the way, where is the link to this judge's decision? Please provide it.

This was four years ago. In the last four years there have been an avalanche of such cases which are working their way through the courts. Victims and lawyers are getting smarter and bolder in seeking restitution as they see all of the success stories like this one.

The county faces a slow moving tsunami of lawsuits from the regimes of Arpaio and Thomas. This $30 thousand doesn't even include the county attorney's fees and other costs.

Maybe when the costs hit half a billion and property taxes double to pay for the hate, some voters will wake up. But it'll be too late. $1 billion in judgments and settlements here we come. A record never approached by any other local government in the United States.

I think we should request the US Border Patrol from the Casa Grande Office to come and patrol this area of Maricopa Co for a year or so. Im sure they would do it an no charge to local governments, and would certianly do the job of illegal immigration enforcement. We could have MCSO enforce traffic laws there, and respond to the domestic violence, DUI, and other crimes....and USBP Agents could be on scene to take custody of any illegals present.

Civil violations of law are NOT criminal matters by definition. Illegal immigration is a civil (not criminal) violation of federal law. SB 1070, making illegal immigration a STATE crime is not in effect - because it conflicts with federal law stipulating that it is a CIVIL offense.

OTOH, individual states enacting their OWN immigration laws IS illegal. Individual states attempting to thwart the U.S. Constitution, aka 14th amendment, IS illegal!

Unfortunately, Elaine, it's not the sheriff who is paying, it's the taxpayers of Maricopa County. The county has liability insurance with a $5 million deductible, so any settlements short of $5 million are paid by the county. The sheriff doesn't pay anything unless a court orders punitive damages after trial...

I see Phoenix P.D. cars driving by my house quite often and if I wanted to call my neighbor and tell him, it would not be a crime.... are you making more laws here that we don't know about? What is MCCSD? Who was being demonized by signs? If Sanchezes had previous contact with MCSO what does that have to do with this case, where reasonable suspicion and probable cause were both absent? How do you justify, in your mind, the false arrest?

You're no doubt correct. It would mean more to them if it was their personal treasuries that were paying out on the civil claims.

I guess it's like the other industries subject to class and personal action claims.They look at the overall picture... which will cost them less... fixing the problem that might do harm to someone and subject them to civil damage claims. Or just leave the problem alone and pay out on whomever does get hurt by their actions or inactions as the case may be.
