Jan Brewer's Bogus SB 1070 "Counterclaim"on a Road to Nowhere

Gee, if we're being "invaded," Jan, why not declare a state of emergency?

Add one part delusion to three parts grandstanding, mixed with a healthy glob of nativism, and what do you get?

Governor Jan Brewer's SB 1070 "counterclaim" against the federal government for not protecting Arizona from "invasion."

You'd think that at least state Attorney General Tom Horne would have sense enough to know that such a claim is doomed to go nowhere.

And perhaps he does, because in his "executive summary" of the counterclaim, he pretty much admits that this maneuver has been attempted before and shot down by the courts.

His summary states that,

"Arizona is unable to bear the staggering cost of protecting itself, and even if it could, the federal government has argued that Arizona is preempted from taking action to assist in the enforcement of federal immigration law. A similar claim was rejected 14 years ago by the Ninth Circuit....We are asking for a second look by the Ninth Circuit, or a first look by the U.S. Supreme Court."

Horne insists that "conditions have changed," but he knows better. This is pure posturing, a stunt to grab the media's attention for two seconds. It's laughable on its face. 

So too is the claim that the federal government has not defended Arizona from an illegal immigrant "invasion."

Now, the use of military metaphors is one thing in the world of ideology, politics and polemics. Hyperbole's to be expected in those realms.

But in a legal document you want the federal court to take seriously? Come on.

Horne's summary asserts that,

"The word `invasion' does not necessarily mean invasion of one country by another, but can mean large numbers of illegal immigrants from various countries."

In the minds of nativist extremists, perhaps. This is exactly the sort of rhetoric they use to demonize Hispanic immigrants.

Agreed, one can use the word "invasion" in a lot of ways. You could say that every November, Arizona suffers an "invasion" of blue-haired snow birds from states like Michigan. But I don't think the U.S. Constitution instructs the federal government to protect us from them. 

Article IV, section four of the Constitution states that, "The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion..."

That clearly indicates a military incursion, not the mass migration of wannabe dishwashers and lettuce-pickers.

Another disturbing claim in Horne's suit conflates the 9/11 hijackers with garden-variety illegal immigrants.

Horne's summary cites "the national security aspect of the [immigration] problem which has become evident since 9/11" as justification for asking the courts to reconsider such a suit of the feds.

And the suit itself states that "several terrorists who attacked the World Trade Center and the Pentagon in 2001 were illegal aliens."

But the 9/11 hijackers did not cross the Sonoran desert, hike across the Canadian-American border, or wash ashore on the California coast. They entered the U.S. via business, tourist and student visas. 

The 9/11 Commission's staff report on terrorist travel notes that, "The 19 hijackers applied for 23 visas and obtained 22. Five other conspirators were denied U.S. visas. Two more obtained visas but did not participate in the attack for various reasons."

Some overstayed their visas or used fraud in the process. But they didn't smuggle themselves across the border. They entered through ports of entry.

And, obviously, the 9/11 terrorists were not from Mexico or Central America. They were Saudi, Egyptian, Lebanese. 

The hype about terrorists crossing the southern border of the U.S.? It's just that, hype. There are easier ways to enter the United States.

In any case, the Horne-Brewer counterclaim has served its purpose. It got Horne and Brewer on the news, and no one had to talk about Sand Land's $800 million budget shortfall.

If Brewer is really concerned that the feds are not securing the border, despite sinking millions in resources into the effort, she could always stop her whining and declare a state of emergency. 

Last year, President Obama sent hundreds of National Guard troops to the border, but conservanuts criticized the move as being not enough. 

Hypothetically, the governor could send down more Arizona National Guard troops. Or she could order every Arizona Department of Public Safety officer to go sit on the border.

In fact, she has the power to do this according to Arizona law, A.R.S. 26-172, which states the following:

When the governor proclaims an emergency, or deems it necessary to protect lives or property, the governor may mobilize all or any part of the national guard or the unorganized militia into service of the state. The order directing the national guard or the unorganized militia, or any part thereof, to report for active duty shall state the purpose for which it is mobilized and the objectives to be accomplished.

As far as putting DPS on the border, if the governor declares a "state of emergency" or a "state of war emergency," she can do it under A.R.S. 26-303. This law says, in part, that,

During a state of emergency:

1. The governor shall have complete authority over all agencies of the state government and the right to exercise, within the area designated, all police power vested in the state by the constitution and laws of this state in order to effectuate the purposes of this chapter.

2. The governor may direct all agencies of the state government to utilize and employ state personnel, equipment and facilities for the performance of any and all activities designed to prevent or alleviate actual and threatened damage due to the emergency. The governor may direct such agencies to provide supplemental services and equipment to political subdivisions to restore any services in order to provide for the health and safety of the citizens of the affected area.

Misapplication of resources? Sure, it would be. But isn't that one of the federal government's arguments -- that it gets to decide how it allocates its resources, not the states?

Surely, if we're being "invaded," Brewer should act -- instead of filing a frivolous counterclaim, one that both she and her Attorney General know is dead on arrival.

Pay no attention to these so-called "Associates". A few of them have already been convicted of either pissing in the street or beating their wife. They've been around for years, still smarting from how the Phoenix Police got the best of them. These are old men with nothing better to do than post in The New Times against Stephen Lemons.

They've been doing this crap for years, posting as if they are some sort of collection of people with some sort of purpose. No one can even understand what they are saying most of the time. They call themselves "Associates" and everyone who's ever read their crap know they are full of crap. They challenge people to meet them somewhere, sometime, then they never show up. Additionally, they will follow up with some stupid claim that they were indeed present at the agreed upon meeting place and time, but they're nothing but full of shit.

What a waste it is to see these guys return to create more hate and division. They've got nothing better to do.

Watch them now come back to criticize this very post of mine, saying "We Associates have conferred on the matter of this poster, after furiously exchanging faxes and emails, and have concluded that . . . " just more "Stoller & Associates" type crap.

These guys are just comedy. Don't take them seriously at all.

I smell a Candy Ass Thomas/Flaccid Fool political publicity stunt with this latest round of 1070 bullshit.

AG Tom Horne, who appears to be as mentally unstable as was his GOP rival in the AG primary, has basically conceded that lawsuits against the feds have failed on more than one previous occasion. Makes me glad I voted for Rotellini. At least she has a brain in her head.

Brewer has had the ability to summon the AZNG the entire time she has been the guv, and she whines that it's the feds job. While she is technically correct to an extent, before turning to the feds, she should have summoned up the AZNG while negotiating with the feds for more border security. That way, at least she could've gone to DC (on the taxpayers dime, naturally) and whined to President Obama that she's trying to secure the border from the 'dangerous' illegals and needs more help.

It's just like putting the Flaccid Fool of MCSO and his mentally unstable right nut in the Governor's and Attorney General's Offices.

Thank you Stephen Lemons for your close examination of this matter and calling the governor's bluff. Is this apparent lawsuit against the feds really legally defined by Arizona as a "counterclaim"? A "counterclaim" to the justified DOJ action against the unconstitutional SB 1070? And does this gem actually use the word "invasion"?

The misuse of the word "invasion" referencing Hispanic migrants (who have unlawfully crossed our southern border) by nativist commenters has been bugging me for almost a year, but it's especially incorrect if Arizona has mis-used the term "invasion" in legal papers of its "counterclaim."

Is the Arizona Attorney General's Office (Horne) actually listed as a plaintiff? Or did he just write an "executive summary" to go along with the governor -- press conference and all -- for political, not legal, reasons? At any rate, I'm glad you pointed out that the vast majority of the 9/11 terrorists entered our country with visas, diffusing his "national security" excuse.

Your best point is the governor's legal ability to declare a state of emergency, if we're being "invaded" and if the feds have done nothing (which is untrue) to combat illegal immigration on our southern border. This is where you've called her wasteful and costly bluff.

I am glad to say that I did not vote for Jan (I supported Libertarian Barry Hess) for governor, and I did not vote for Horne (He had Candy Andy's backing. It appears that some of Candy's mental instability rubbed off on Horne. I voted, safely, for Rotellini for AG).

Gee, I wonder why Arizona has 10% unemployment, 2nd poorest state in the U.S., next to Mississippi (they, too, have Republican Gov. Haley Barbour), more than half of all mortgages underwater....

I'm almost sure they did this knowing full well it will go nowhere and be shot down very fast based on previous attempts. As Lemons and other experts have pointed out, the use of the word "invasion" is quite dubious and almost assures them of being laughed out of court. But...sb1070 is off most of the nation's mind now and the donations to the fund had come down to a trickle...From what I can find, they had $3.5M in September of last year but as of February they'd only picked up about $200k more. Factor in that from Sept - Nov of last year their cost to defend was $1.6M, taking the fund down to $2.1M. As well, figure that they used up at least another $1.2 between December - February, and I'd bet that fund is somewhere around $1 - $1.5M at this months end.

Now, I'm sure Brewer didn't and couldn't do the math but someone looked and realized that if it was going to take $1.6M just for 3 months they were going to be out of cash real soon....like maybe 3 months. And, I think there will be a lot of backlash if she has to tell people it's going to be taxpayer funded. So, they bring the issue back up in grandiose manner, complete with her screeching and whining and they get some more fools to pony up a few more bucks.

I'd almost bet she's inquired to see if they could put a donation option for this on this year's state tax forms and that they'll make some sort of push for people to donate when filing state taxes.

I hope Lemons and others keep an eye on where they stand with their cash and the reporting of it.

Immigration laws are to protect the economy and citizens of the host country. Immigrants must be self-sufficient and able to support themselves with a legal job or sponsor. Immigrants must pass a health screening and background check. Immigrants must pay fees and costs associated with legal immigration. Illegal aliens go thru none of these things. Illegal aliens break our laws, drive down wages, take our jobs and victimize our citizens. Illegal aliens take whatever they can regardless of the negative impact it has on our country or our people. If you want to be fair, adopt the same immigration laws Mexico has. 2 years in prison for the first offense, 10 years for the 2nd offense. The free ride is over, we're broke! ILLEGAL ALIENS GO HOME!

And what does it cost the taxpayers to house an inmate? $35,000 or more a year depending upon their health conditions. Why do we want to incarcerate illegals? Who profits from this? Find a way to send them home. Arizona is a enough of a prison state already.

Now that sounds like a great idea.

Average annual cost of incarceration per inmate = about $22,000

Number of undocumented immigrants believed to be living in the U.S. = about 11.2 million

Multiply those two numbers and you get...about $246 billion per year to incarcerate them all.

Not to mention, the total inmate population of the entire country is about 2.3 million, and you're proposing to increase it by a factor of about 5, so, you'll need 5 times the amount of current prison space, and 5 times more prison guards, who will need to be paid salaries, benefits, etc., and 5 times more administrative and support staff for these facilities.

On balance, though, it's a terrific idea. Please regale us with more of your brilliance.

There isn't a single solution that will fix the problem, but if new Know-Nothing party was serious about stemming the flow of migrant workers, harsh punishments for employers and profiteers of illegal labor, including asset forfeiture would be a good place to start.

Not going to happen though. AZ's multi-billion dollar agriculture and hospitality industries absolutely depend on undocumented stoop labor and pay politicians handsomely to preserve the status quo.

Much easier and more politically expedient to kick the powerless in the teeth than to work toward practical solutions.

I really think the State of Arizona is fast approaching the time when the federal government is going to issue a letter of warning. Said warning will indicated that all federal funding, all federal employees, all federal agencies and any and all federally owed property will be removed from the state if the obstreperous activity demonstrated by Brewer, pearce, kavanaugh, trents and others doesn't stop. The people of America are just beginning to understand the cost of illegal immigration? ITS not millions of dollars, but in truth its over a hundred billion dollars each year. It starts with the burden of Plyer Vs. Doe in the federal court system, that mandated an education for all illegal alien child up to K-12. It's not just the federal government that pays for this out of your taxes, but States also must extract money from their own taxpayer’s base. A proportion of legal scholars see the Texas Pyler v Doe as a dismissal of Congressional empowerment; as a challenge to make up for the legislative branch's indifference and rampant neglect in dealing with the illegal immigration invasion through these last thirty years. This has became the highest pinnacle to judicial advocacy at its worst; starting in 1962. It is no wonder schools are now crammed with the children of illegal aliens, and that doesn't give much room for our own citizen students and resident aliens to receive a decent education.

Our government should not be siding with any foreign corrupt administration, but standing for the US people. Instead of playing an evil Uncle Sam they should not be contesting Arizona’s right to financial survival and giving no support to any Southern neighbor or patronizing them against our own citizens. A well publicized example is the failure in the California classroom, which has descended to around 30th in performance against other States. Public education is the largest expenditure to the US government, states and local governments sustained on behalf of illegal aliens. A reputable immigration projection indicates it will account for 96 percent increase in the school-age population in the United States over the next 50 years. Illegal aliens will account for as much as half of the increase, if our laws are not severely enforced. However, this is only a tiny scratch that doesn't even touch the under surface of paying for just about everything for illegal aliens, specifically those who inherited instant citizenship for their children.

Then we have the illegal worker using fraudulent ID documents to get a job. If that same identification can get a job, surely they can use those papers to mislead public servants to apply for every conceivable welfare benefit. Make a point of joining the TEA Party, or a pro sovereignty organization such as NumbersUSA who allows free faxes to your lawmakers. Lawmakers running around trying to outdo each other for the most offensive and inhumane bills; playing God with reproductive rights, deciding who will be an Arizona "citizen", rewriting the 14th Amendment, deciding who makes a better parent, putting guns in public buildings, schools and university's, all the while completely sidestepping the states growing economic, educational and budget issues.

And we get a speech on immigration.

If this wasn't Arizona, I wouldn't believe it.
