Russell Pearce's Unconstitutional, Un-American Attack on U.S. Citizen Children

So was anyone surprised by neo-Nazi-hugging state Senator Russell Pearce's press conference yesterday announcing that he'll be targeting U.S. citizen children in a racist attempt to undermine the U.S. Constitution's 14th Amendment guarantee of birthright citizenship?

Well, you might have been had you read an October 10, Associated Press piece discussing those Republicans vying to be the next state Senate president. Pearce is one of them, and he assured the AP that despite his love of ethnic cleansing, he would be taking a back seat on the immigration issue if elected state Senate president.

Check this excerpt:

"Pearce said in an interview that if elected Senate president he plans to let other lawmakers lead the charge on 2011 legislation on illegal immigration. Those could include legislation to deny U.S. citizenship to children born in this country to parents who are both illegal immigrants and to toughen the employer sanctions law."

And this one:

"His being elected president `probably helps' the chances of additional legislation on illegal immigration, Pearce said. `I will help usher those bills if they're good public policy.'

"On the other hand, `for those folks that are a little wimpy on this issue, the best thing they can hope is that I'm president because my time will be spent doing a lot of other things that are very important,' he said. `My biggest concentration will be growing jobs, reducing the burdens on families and businesses, and balancing the budget.'"

Hmmm, bullet-head cracker from Mesa speak with forked tongue. Not that it's a first for Pearce, mind you, who spews bogus stats whenever he needs to bolster his nativist agenda. 

But, what did it take, nine days from the publication of that AP article till Pearce was holding a presser, vowing to deny birth certificates to American citizen children born of illegal immigrant parents?

How much you wanna bet Pearce's campaign for state Senate president ain't going so well? After all, that AP interview was Pearce's lame attempt to make himself seem somewhat moderate, and not the anti-Mexican nut we all know him to be.

I've addressed the racist attack on the 14th Amendment at length in a past Bird column, so I won't go over all that old ground here. However, I do want to point out that what Pearce and his xenophobic allies are attempting is illegal under the highest law in the land, the U.S. Constitution.

Because other than granting birthright citizenship, the 14th Amendment also prevents the states from stripping citizens of their rights as enshrined in the Constitution.

Indeed, the 14th Amendment says that, "No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States."

Now isn't that exactly what Pearce is trying to do? And therefore, isn't he "breaking the law"? You know, just like the illegal aliens he so obviously hates?

The women who cross our border illegally for the purpose of having her baby born on American soil should have two choices. It doesn't help to have every child born in the US as a citizen if their parents aren't voting Democrat. What is needed is to get these people voting to ensure that the evil Republicans can never again gain power. A massive tide of immigrant voters can make this a reality.

We just have to figure out a way to get these people so their votes count. Each state is drafting “legislation” which will be determined by constitutional scholars, who ultimately intend to assist in amending the Constitution to deny citizenship to children of illegal aliens.

Wait a minute here where is it stated that the desire is to strip the citizenship of children who already have it by virtue of the 14th? This topic heading is blatantly misleading and inaccurate.

Most countries require that at least one parent be a citizen or legal resident in order for a newborn to qualify for birthright citizenship. Are you claiming that the amendment can't be changed to reflect this criteria? The writer's of the 14th never intended for children of illegal aliens to gain citizenship in that manner anyway.

The amended amendment would only change for future births in this country after it passed. It would not be retractive and strip citizenship from those who already have it. Geez, debate with honesty!

I find it amusing that those who don't want birthright citizenship to change interjecting racism into it when it would affect the children of ALL illegal aliens, not just one racial group. Why is it ok to seek change to our immigration laws by these same people but not ok to change the 14th (or at least re-interpret it the way it was meant to be by the writers of it)?

OK. Let me try to figure this out. It is against the law to enter this Country ILLEGALLY. Correct? OK. However, if you do come into this country ILLEGALLY and have a child, we will reward that child with a U.S. birth certificate and make him or her a citizen of the United States, pay for the birth and get the child on welfare so the mother can get money to stay in this country...and that's not ALL! We will school that child and the child will get food stamps, the child will get FREE school lunches, and that's not ALL! Repeal the 14th, then amend the law so that anybody who gives birth in your house is automatically entitled to 1/3rd of your estate. The homeowner, in turn, is now liable for the expenses of their new family member. This would allow the proponents of spontaneous naturalization to put their dinero where their pie-holo is.

The biggest news in this story was ignored. During the press conference, a very telling statement was made - inadvertently I believe - by John Cavanaugh. He said that a person should not be a citizen because they happened to have been CONCEIVED in the United States. I've been pushing this idea for a while now with no takers in the media. Having a zygote or embryo designated as a U.S. Citizen is the goal of these yahoos. This legislation will pale in comparison with the anti-abortion laws they will push through! Rather than be in violation of a simple law that makes illegal the act of abortion, one could be in violation of a new law, courtesy of the next session of our Republicant legislature, that would make it a crime not to REGISTER WITH THE STATE every time one engages in an activity that might result in the conception of a human zygote. Legal scholars of the note including Richard Posner of the appeals court and University of Chicago law school and Peter Schuck have argued that congress and congress only have the power to confer citizenship. If they are right, the 14th amendment does not necessarily confer citizenship. If you are looking for a Supreme Court decision that argues being born in the territory of the United States one can go to ELk v Wilkins. Just food for thought.

Your stupid ass employer sanctions law got a Subway Sandwich shop closed for two days and....nothing else. Here's a new way of looking at things: When it comes to the US Constitution, it seems that Democrats, Progressives, "Liberals", anyone to the left, are actually the conservative ones. That's right . . . The "Liberals" are truly conservative when it comes to the US Constitution. In other words "Leave it alone". In truth, the Teapublicans, in wishing to alter the constitution, especially with the aim of denying civil rights, are being "reactionary", or backward. In fact, to attempt to deny anything related to civil rights shows as lack of a sense of history.

Conservatively speaking, THIS Liberal would like to point out that the purpose of the US Constitution is to protect rights, not deny them. The Right is trying to circumvent this by attempting to deny initial citizenship, therefore, denying the rights of this country. To this, I'd like to point out that this country has a history of trying to impose it's values on countries elsewhere . . . so it is hypocritical to deny such on our own soil.

Before any more propaganda could possibly be thrown back at this, I'd like to point out that America will need people in the future and, frankly, not enough indigenous people are having babies. The "Immigrant Horde" that Pearce and his Arizona Republican TeaTurds are so afraid of actually comprise approximately less than 2% of the entire US population. That's about 6 - 10 million in about 250 million. They really pose no threat. (And if it is a matter of economic affordability for services, I think ending the endless expensive military conflicts this country has been engaged in for the last ten years ought to cover it, doncha think? Ever put any thought to the idea that such expensive conflicts could be the real and true reason why we are so broke?) But the difference in disposing of them has already helped to create a downward spiral in Arizona's tender economy.

History has already taught us that immigration expulsion legislation fails, always. In other words, idiots like Jet, who only espouse right wing talking points in their support of Nazis like Russel Pearce, are not thinking long term. Damage Control means nothing to people like Jet.
