Joe Arpaio in the Feds' Crosshairs: Dennis Burke's Team To Be Sworn In as Special Deputy County Attorneys

It's not lookin' good for Maricopa County's corrupt top constable, Sheriff Joe Arpaio, and that bottomless pit of iniquity known as the MCSO.

You'd think things were bad enough with a federal grand jury probing the sheriff's office on criminal abuse of power allegations, and intertwining investigations by the FBI, the state Attorney General, and U.S. Attorney for Arizona Dennis Burke. Not to mention the U.S. Department of Justice's inquiry into the MCSO's civil rights abuses.

But now interim County Attorney Rick Romley will be deputizing six Assistant U.S. Attorneys from Burke's office to be Special Deputy County Attorneys, with the power to investigate and prosecute state crimes, as well as federal.

According to an agenda item for the next Board of Supervisors meeting, the Supes will be voting on approving the appointments Monday. My sources tell me its a done deal. And none too soon, as Arpaio's bought-and-paid-for-ally Bill Montgomery will be sworn in as the new CA as soon as Tuesday's election is certified by the BOS.

The BOS agenda item makes it clear that these new cross-deputized law dogs will be looking into "any state related charges that may arise in connection with the current federal investigation" into the MCSO.

Also, the team will be investigating state crimes possibly committed by the MCSO as outlined in an October 6 letter to Burke from County Manager David Smith.

That letter details a laundry list of alleged felonies under state law, from destroying documents and outright theft, to forgery and fraudulent schemes. (You can read the letter, here.)

I'm being told that these six AUSAs -- some of whom are former Deputy County Attorneys -- have already been working on the grand jury investigation of the MCSO. The mere fact that there are a half-dozen of them indicates the seriousness of the U.S. Attorney's probe, and the U.S. Attorney's clear intent to secure indictments.

These six untouchables include the following top members of Burke's staff: Rachel Hernandez, the Executive U.S. Attorney for Burke's office;Patrick Cunningham, Burke's "criminal chief"; and John Lopez, chief of the financial crimes and public integrity section.

In other words, this is no joke. Burke's office is targeting the MCSO in a very high-profile way. And recently Burke has been more outspoken concerning the MCSO's nefarious deeds. 

In a letter dated October 22 to Rick Romley, Burke stated there was a "total lack of evidence" to back up the bogus RICO suit that Arpaio and his former fellow Sith Lord, ex-County Attorney Andrew Thomas, ginned up against the county. 

And in a  letter to county Supervisor Mary Rose Wilcox dated October 5, Burke confirmed that allegations of wrongdoing in the leaked memo by MCSO Deputy Chief Frank Munnell were being "fully investigated" by his office and the FBI.

When Burke was sworn in last year, I wondered openly if Burke had the stones to be this state's Eliot Ness when it came to cracking down on the Sand Land version of Al Capone; i.e., Joe Arpaio. 

I admit, I had my doubts, but they've been allayed by Burke's recent statements and by the pending swearing in of these six federal prosecutors as special deputy CAs. I simply urge Burke and his people to keep their eyes on the prize in all this: the indictment of Sheriff Joe Arpaio himself.

Thanks for this, Mr. Lemons. Three questions:

(1) Do Special Deputy County Attorneys have a fixed term during which their deputization remains valid, and if so how long is it?

(2) Who is authorized to renew their term if it expires automatically after a fixed time? Just Montgomery, or can someone else? If someone else, is Montgomery's approval necessary as a co-sponsor?

(3) Can Montgomery rescind their deputization after coming into office?

I don't know if I see two investigative standards. In one case, there is apparently evidence of substantial federal crime and evidence of state crime as well. In the cases referred by Arpaio and Thomas, the feds found no evidence of federal crimes and no apparent evidence of state crime. However, since they were not authorized, it was suggested to Romley that it be referred to someone with jurisdiction to make that determination.

As much as I'd like to see Arpaio go down, I'm a little disappointed in the way the US Attorney is handling this. He's got two separate investigatory and prosecutorial standards: one for the Supes and one for the Sheriff. The Supes only get a cursory look into what was literally handed to them by Thomas and Arpaio.There was no independent investigation into their actions. The USA passed the buck on any state charges to the Navajo County Attorney. (Please. I know you'd like to knee jerk defend the Supes because they're *now* Arpaio's enemies, but they're no saints. In fact, they coddled and co-conspired with him for years. Unfortunately, if there is something on them, we won't know now.)

When it comes to Arpaio, however, the USA is conducting an independent investigation and, rather than passing state charges off to NACO, is deputizing AUSAs to prosecute those too. This is a recipe for political failure, if not legal failure.

Are there no non-partisan law enforcement officials left in Maricopa County? It appears not. If this plays out as expected, we may get rid of a corrupt sheriff, but we'll be left with a more powerful and nearly as corrupt board of supervisors. Who will then step up to the plate to get rid of them?

How did the repeated statements go?

As a high ranking DEA agent, Arpaio should know that these things take time, but when you are playing nickel bag cop in a 100 lb world, little busts don't take so long and you can get a lot of them. The 100 lb bust takes a while to develop and you probably can't get one a day.

I must be a big pile of stuff they are looking at. Deputizing 6 such attorneys is really quite a bunch it seems. They simply must smell blood in the water. The agenda item to the BoS to approve these appointments state that there will not be a cost impact to the county.

This tells me:

They have found Federal crimes that the DoJ believes they should prosecute.

They have found related State crimes that the DoJ believes should be prosecuted by the same team.

The investigations have been comprehensive and complicated. At one point I suggested that sorting out the MCSO criminal mess was going to be like looking for a needle in a needle stack. The investigations are not over yet and need to branch deeper into the state level at this time.

Federal indictments may be close. State indictments may follow in a year or so.

The peril of those that are criminal targets is quite profound at this point.

Finally, I am glad that my name is not Arpaio, Hendershott, Fox, Black, Thomas, Aubuchon, and I am sure there are a few others.

The Associates are not commenting on Joe Arpaio's and the MCSO's guilt or innocence, but some have expressed outrage that Arpaio never assisted them in their civil immigration enforcement efforts. One stated, "He's just showboating for attention - we're doing the real work. He left us high and dry."

They are pushing Arpaio aside it seems and focusing on Obama these days, in addition to fighting their OKON v PHOENIX immigration enforcement case all the way to the U.S. Supreme Court. Whether Arpaio's guilty, innocent, or in-between, these Associates claim that Burke and his appointees have no authority to prosecute Arpaio, et. al. because they are illegally-appointed by illegally-appointed U.S. Attorney General Eric Holder. They further claim that Holder was appointed after the "criminal usurpation" of The White House by "Barry Soetoro," which they claim is President Obama's real name.

Regarding Arpaio, an Associate asked, "Why the fuck are we fighting Arpaio's battles for him, and challenging Obama when Arpaio's too chicken?" This Associate was literally bellowing into the phone like a deranged madman, but eventually he calmed down to a level of moderate psychosis.

They have repeatedly been E-mailing us with press releases and documents, alleging that Obama used a stolen Connecticut Social Security Number, 042-68-4425, and a forged selective service application to qualify for the 2008 election.

Whether you agree with them or not, these Associates are one ballsy bunch of people. We can never accuse them of picking on the little guys. Maybe they just got bored with local affairs, and went national and international for more excitement.

Very good news for those of US who hold certain members of MCSO in complete disdain. Bad news for those very same folks.

The fecal matter will be plummeting from the top of one very greasy head of hair downhill, over yonder and dale, in and out of very deep crevasses of congealed fat of certain deputies and then oozing at the feet of some vociferous lieutenants and sergeants, then meandering along and infecting those employees who have been wallowing in the muck all along.

Gerry, If you look at the letter Burke sent to Romley on that matter, he basically said all they did was review what Thomas and Arpaio sent him. That's a review, not an investigation. I have no doubt that Burke told the truth on that point and what Thomas and Arpaio sent over did not show evidence of a crime. Those two fools couldn't find their arse with both hands and a flashlight. That's why we need someone to really investigate any evidence of wrongdoing by the supervisors. With Arpaio, on the other hand, the FBI have been conducting their own independent investigation for two years. As it should be. And as should be done with any corrupt politician. But that's not what is going on here and, in the end, it will only lead to the Arpaio wingnuts calling this a partisan witchhunt. (See below.)
