Worse Than Joe Arpaio? Tucson Police Department Turns Over Mom and Dad To Border Patrol as Kids Cry

Although activists are normally up in arms about Maricopa County Sheriff Joe Arpaio separating mothers from their children and otherwise breaking up families during his anti-immigration sweeps, this video by Tucson's Three Sonorans blog reveals that things may be even worse in the Old Pueblo.

In the blog post, the author states that it was just a dad who was taken away by Border Patrol after a routine traffic stop by the Tucson Police Department. But there's a woman being taken away by BP agents as well.

This is what TPD PIO Chuck Rydzak told me about the stop via e-mail:

"Officers from the Tucson Police Department were on routine patrol when they observed the noted vehicle being operated without any brake and tail lights. Due to the defective equipment the vehicle was stopped.  During the interview of the driver he produced a Mexican Drivers License but no other information as to residency or immigration status.

As per normal practice Border Patrol was called to the scene to ascertain his status. Upon Border Patrol's arrival within 10-15 minutes it was discovered that both the driver and his wife were undocumented and they were taken into custody. The children were released to their Aunt who also arrived on the scene."

Note the phrase "as per normal practice." I called Rydzak to follow up, and he told me this is standard operating procedure for the TPD when encountering the undocumented. In fact, it's part of TPD's general orders, specifically general order 2119.1.

Rydzak estimated that this order has been in place for about five years now. Guess the nativists can't complain of Tucson being a "sanctuary city." Rydzak said such turnovers to the BP are routine and insisted that it had nothing to do with SB 1070, or what's left of it, after it went into effect July 29,

He also said that he could not release the names of the mom and dad to me because no arrest had been made.

True to form, the Border Patrol advised me that they couldn't release the names either. However, Border Patrol Agent Colleen Agle of the BP's Tucson Sector explained that the individuals have the right to speak to their attorney and their consulate.

Still, talk about a media blackout. You'd think this pair had been "disappeared" like in Argentina during the '70s.

A public records request to BP might turn up the names, but that will take time. Rydzyk said there was a report written on the stop by the TPD officer, but that TPD would normally redact the names in such an instance.

At least we know that a video I blogged about on August 6, showing another turnover to la migra by TPD, was not an aberration. However, the question remains whether or not TPD as stepped this practice up in the wake of 1070.

All the same, how odd for a city that's considered to be one of the most liberal in Arizona and is about 40 percent Hispanic, according to a U.S. Census Bureau analysis.

And I thought Maricopa County was bad...

I wasn't equating murder to misdeamor trespassing. My point was that regardless of the crime or status of the lawbreaker the fact that they have children should have no bearing on being punished for their crime in accordance with the law.

So it is bigoted to not want our immigration laws to be changed so that there are no quotas on legal immigration? We should allow every person who has managed to slink over our borders illegally and those still wishing to, to come here in unlimited numbers? Do you also expect other countries to have the same policies or is it just the U.S. that should have no immigration policies and quotas and have their borders erased?

Couldn't agree more. These "innocent people" wouldn't be in this situation of they stayed where they belong or went through the proper channels to be here legally. Looks to be 2 separate issues that most folks are mixing up.

First is, lots of folks seem to be getting up in arms over the fact that the parents were taken away from the kids and given to an aunt to protect and care for them. Well what the heck do you want them to do? Under the FEDERAL LAW that super ceeds SB1070 , LEO's can not ask for documentation of people 17 years old or younger, the reason being is that the federal law DOES NOT REQUIRE THAT THEY carry it.

Issue 2.The parents were driving a vehicle in the US that did not have properly functioning safety equipment and all the ID they had was proving them to be citizens of a foreign country. Since they did not have the supporting documentation that would have proved they were in the US legally. With all these factors in play these folks appear to have been looking to get stopped by the LEO's.

The point of SB 1070 was to make it so that locals wouldn't even have to call an immigration authority and verify immigration status in order to have people torn from their families. It would have made 'illegal presence' a state crime for which people would be taken to state jails/prisons based on the flimsiest of pretexts. Of course this would have been a major boon to the shurf's dept. and the local prison industry as the county's brown population was rounded up, and all on the taxpayers dime too. All this over what amounts to a misdemeanor trespass law.

Get off your high horses you f*cking bigots. You refuse to consider any reform that isn't more punitive than what we have now. That is because you are in fact Anti-Immigrant, and not merely Anti-Crime as you so defensively claim. If what you are against is the "illegal" part of immigration then you should support a path to citizenship for all non-criminal aliens and their families,('amnesty' - the very word exposes your bias) and a less punitive term for re-entry application after deportation. The fact is that our policies ARE anti-immigrant, and so are you.

And Yes, I feel for the families of American lawbreakers, since we tend to make felonies of victimless crimes. If you want to make Arizona safer by preventing the crime/death associated with cross border traffic then cracking down on residents is not the answer. The only solution our problem has always been the one that no one is willing to even talk about. ENDING DRUG PROHIBITION! The more time and money we spend on 'cracking down' on victimless crimes, the less resources are spent on everything else.

It's simple. The more Border Patrol are in downtown Tucson rounding up drivers with a tail-light out, the fewer there are PATROLLING THE BORDERS! Law enforcement resources are finite, and more/harsher enforcement is not the answer to our illegal immigration or border crime problems. It is, however, the only solution that is politically correct to suggest, which is why the president can eschew real immigration reform in favour of the same tired tactic of throwing more federal tax dollars and soldiers at the problem. Einstein's definition of insanity is doing the same thing ad infinitum expecting different results. American policies on both drugs and immigration are, by this definition, plum Loco.

Sooo.... okay it seems to me that any hardship endured by the kids is because the parents didn't follow the rules. Looks like the Police did their job and the parents didn't by coming here illegally and putting their kids in that position.
