Tom Horne Declares "It's Over," Leads Andrew Thomas by 853 with Around 4,500 Ballots Left

State Schools Superintendent Tom Horne declared victory Saturday night over former Maricopa County Attorney Andrew Thomas, his rival in the GOP primary for state Attorney General. This, after today's count left Horne 853 votes in front, with only around 4,500 votes left to tabulate across Arizona, according to the Secretary of State's office.

"It's an absolute certainty now," said Horne when I called him not long after the latest results came in at 8:13 p.m."The remainder should be split evenly."

Horne said he had yet to hear from Thomas, but that it didn't matter if Thomas wanted to wait for Tuesday, when all counties in Arizona are required to report.

"It's done," he told me. "It's over."

Indeed, Maricopa County Elections issued a press release stating that it had counted the last of its ballots by Saturday night. All that's left are the official results for write-in candidates.

SOS spokesman Matt Benson said that Pima County is done as well, with only around 4,500 ballots remaining uncounted across the state.

Horne expressed "a huge sense of relief" over the near-final results, explaining that his anxiety levels have been waxing and waning with each new release of information from the SOS.

Although Thomas began election night ahead, the tide reversed early Wednesday morning, and Thomas never regained the lead, though he cut it to within a few hundred votes at times.

After Horne went up 1,073 by the end of Thursday, Thomas considered dropping out of the race on Friday. But when Horne's advantage was cut by more than half as the counting went on, Thomas declined to concede until all the ballots were counted.

Horne's already focusing on the winner of the Democratic primary for AG, Felecia Rotellini. He said he feels confident that he will beat the former state banking czar, who served under Democratic Governor Janet Napolitano.

"It's better to be a Republican than a Democrat right now," he explained.

The reasons? Immigration and SB 1070.

"I supported it, she opposed it," Horne said of Rotellini's criticism of 1070, even though she has promised to defend it if elected.

He said he would fight for SB 1070 if he becomes Attorney General, and that he would take over the case from the firm of Snell & Wilmer, now defending it in federal court against its various challenges.

"I would expect to win that in the Supreme Court," Horne said of challenges to the law. "We don't need to spend all that money on private attorneys."

He offered as proof that he could prevail, a 2009 win before the U.S. Supreme Court in Horne vs. Flores, regarding Arizona's funding of English-learning programs. The Supreme Court sent that case back to the 9th Circuit Court. Before that, a U.S. district court judge had threatened Arizona with $2 million a day in fines if the state did not comply.

Horne along with GOP legislators led the charge seeking a Supreme Court review of the case.

Horne is correct to note that immigration and SB 1070 are the defining issues of this campaign season in Arizona. Also, it's obvious that Horne will attempt to hang Rotellini with her anti-SB 1070 stance.

The challenge for Rotellini will be to change the game while not looking "soft" on immigration. It's a tough dance for Arizona Dems, one current Attorney General and Democratic gubernatorial hopeful Terry Goddard has so far botched.

At least Thomas is considering or did consider conceding. That beats J.D. and his temper tantrum attitude.

At this point, a Thomas concession is irrelevant and is not even news because there is no effect of finality in what Thomas does. The train has left and indecisive Andy is still trying to figure out what to do.

I have often written about Thomas having a lack of integrity and honesty. I still believe that. However, it is notable when Thomas says something truthful. The other night, Thomas stated, "There is still serious corruption in Maricopa County and somebody has to get a handle on it." I thought yeah, right Andy. Upon reflection, I think Andy was telling the truth. There is indeed serious corruption in Maricopa County and someone should get to the bottom of it. Andy has just got the wrong corrupt individuals in mind. He need not look very far.

A final thought is that it looks like at least 270,000 more people in Maricopa County have joined the conspiracy to deprive Andy of his government job.

What's come out of the primary? Arizona allows a Sheriff to "control" the state. The County Attorney needs oversight and accountability. The fact the Montgomery says he's going to partner with the agencies is NOT good news. That's what Thomas, as County Attorney, riding herd over the justice system, did with the Sheriff! What happened with separation of powers?? MCAO Thomas allowed the Sheriff to run-rough shod over the Maricopa County Superior Courts -- witnessed by the world with the video of his detention officer swiping documents off the defense attorney's desk, behind her back, while the judge and the prosecutor sat nonchalant, like "business as usual"= broken justice system, people!! Wake up!!

Dan Saban should not make another attempt at MCSO. It is clear he does not have the record to beat the Arpiehole campaign machine. I would love to see a candidate with a huge legal team prepared to set traps for the unethical and always dirt launching Arpaio machine. And a strong personality to battle the political insurgent fight that will come from MCSO employees once Arpaio is defeated. Battling Arpaio and Hendershott is unlike another campaign and will take a two year preparation. Waiting until the last minute and "playing nice" in that campaign is certain defeat. Hit Arpaio hard and often and in every direction because Arpaio will certainly do the same. No statesmanship there.

The criminal charge filed against Tom Horne:

Court records show that on the morning of Sunday, October 21, 2007,Officer T. Mataele of the Scottsdale Police Departmentclocked a Jaguarautomobile speeding 27 miles per hour above the posted speed limit of45 mph on Scottsdale Road in Scottsdale, Arizona.

Officer T. Mataele pulled the vehicle over. The driver presented adriver’s license identifying himself as Thomas Charles Horne, date ofbirth 3/28/1945. (Although there are many individuals named ThomasHorne, the date of birth shows the individual is, in fact, AGcandidate Tom Horne.)

Officer Mataele issued a criminal citation to Horne, charging him withviolating A.R.S. 28-701.02 A2. This is a CRIMINAL charge (not civil)that subjected Horne to a maximum possible sentence of six (6) monthsin jail, three (3) years probation and a $2,500 fine.

On October 20, 2007, a criminal arraignment was set for Horne. OnNovember 8, 2007, defense attorney Jeffrey A. Van Norman filed aNotice of Appearance to the court indicating that he would berepresenting defendant Horne.

On January 8, 2008, after negotiations between Van Norman and theScottsdale prosecutor’s office, Horne was granted a plea bargain forthe criminal charge he faced. The Scottsdale prosecutor agreed todrop the criminal traffic offense charge against Horne for violatingA.R.S. 28-701.02.A2 in exchange for Horne pleading guilty to a civiloffense of violating A.R.S. 28-701A.

The plea bargain was granted despite the fact that the civil charge ofA.R.S. 28-701A normally applies to drivers going 16 to 20 miles perhour above the speed limit. Horne was going 27 miles per hour abovethe speed limit. In any case, this reduced charge enabled Horne toescape having a criminal traffic conviction on his record and avoidjail time.

On Friday, August 21, 2009, the Arizona Republic broke a storyreporting that Superintendent of Public Instruction Tom Horne receivedsix photo radar tickets in 18 months, including one for speeding in aschool zone.

However, if you combine (1) Horne’s six photo radar tickets with the(2) never-before-reported criminal speeding offense, Horne receivedSEVEN known traffic citations in an 18-month period.

Thanks for the info on the signature requirement, Tommy. I guess I better start asking some questions very quietly to see if the person I know of is still planning to turn into an Anti-Arpaio pit bull on the ballot. As bad as Arpaio is, he still has a cult-like following. I think this person is probably going to want to hold off until near the last minute to announce he is running (if he still is - it's been several months since he stated his intentions quietly to a friend of his who is a friend of mine). But I also think that this person would have a really good shot at taking Arpaio out. Ironically, Arpaio's unethical and dirty "Re-Elect Sheriff Joe in 2012" ads might be part of the ammunition used against him in 2012. If he does indeed get fined the $400,000 they're talking about, he might have shot his own foot off in the process of trying to buy his friends' ways into office. That would taste really good with some melted cheese and and icey cold one!

We will be glad when the lady has sung and this is official. I'm glad Mr. Horne has prevailed. This will help the former thomas crowd see the light and move over to support Felicia Rotellini. Felicia, as Attorney General, will certainly enforce SB-1070, as she will all laws. The big difference is, she won't tolerate abuses of 1070 or any other laws, by any law enforcement agency, such as MCSO.

We can expect the MCSO camp to generate some vile ads soon. It's not yet determine who the target will be however; Horne, Rotellini, or both...

I suppose if the MCSO shurf wants to really hurt Horne he could 'endorse' him as he did Mr. Parker. Or, he may want to take the kid, Ben, under his tutelage and really bury him. Ben who? aka Brock Landers.

Question for people with election saavy:

Candidates need to collect signatures to get their names on the ballot and the signatures have to be "valid".

Can you sign off on more than one candidate? For example, if someone from Saban's camp came to me for a signature and I signed, would that preclude me from signing off for the candidate that I have heard is planning to run? Or can I sign off for each and every opponent to Arpaio?

As for a possible contender running against the senile top KKKonstable. It was rumored to believe that Dan Saban's eventual return from the dead. Call it--"The return of the Lawman". There may be another candidate but I don't know, other than Dan Saban himself.

True, but having the County Attorney bought and paid for by Arpaio does not bode well for Maricopa County. I'm waiting to hear from the Romley camp about running as a write-in on November 2. He has until September 23 to register and get signatures. I'm willing to roll up my sleeves and help if he's throwing his hat into the ring for Round 2.

Also, I've seen a few posts somewhere (can't find them now) that there is someone starting to campaign to run against Arpaio in 2012. Any truth to that rumor? Anyone know who this mystery opponent is? I know of someone who has said they are going to take Joe on, but that person has not made his intentions publicly known yet, as far as I know.

If there is one thing that I hate about Tom Horne, its his despisable legistlature banning ethnic studies in public schools. Every true non-White Patriotic American should be outraged about that. But at that same time, its worth noting that arpaio doesn't exactly like the guy either. Hence his lame ads slandering Horne. It would be interesting to see how these two will play it out. I believe Horne will be so spineless as to what Goddard ever was, in terms of dealing with a geezer simpleton like arpaio. He'll probably be another suck-up, to make the nativist proud.

ps - It's no wonder Thomas and Arpaio were hell-bent opposing the building of the Court Tower. They knew where everything was in the old Court buildings. They won't be able to do the same in a NEW building that they no longer can control!! We can see this as "clear as saran wrap"!!

If Horne were to win the position as A.G, which I personally don't think will happen, he could just get himself a couple cars and drivers to schlep him yonder and gone, just like the Flaccid Fool of MCSO. That should take care of his lead foot problem. I have found that a hands free cell phone works really well while driving, so I don't have to hurry to get anyplace. But that's just me and I'm not nearly as important as some Republican running for attorney general.

That statement comes from the standard nomination petition. Just ONE signature per office per primary.... so you have to make a choice. I ran into the same issue between Dougherty and Parraz... as example.

Liz, I've heard those rumblings too. Don't recall where, but if I were a gambling man, my money would be that Dan Saban will announce his candidacy soon. Why not? There's already a Scottsdale cop announced to run as a Republican. If Dan runs again I would hope the state Dem party would be wise enough to throw their support behind him this time around. Also, let's start thinking about what we have to do to knock pearce out of office. If he's not indicted with the MCSO gang....

We're sure he's been looking for something or the "Thomas camp" wouldn't have posted the police report on Horne's speeding tickets. At least it's Horne's personal car rather then one of the fleet of costly vehicles the Arpaio/Thomas team use for themselves at taxpayer expense!!
