Arpaio shrugs off his arrest of an innocent American girl
If you're Hispanic in Maricopa County, Sheriff Joe's goons have probable cause to arrest you on suspicion of being undocumented. Hey, they can always release you later.
That's the word from the elephant's mouth after an MCSO raid on four area McDonald's yesterday that netted an American citizen, Viridiana Ramirez, who was cuffed and held for four hours as she pleaded with MCSO thugs that she was born in this country and could prove it.
What was Arpaio's response to the news that his Kris Kobach-trained deputies has violated the civil rights of a single mother and terrorized her no end?
"That's just normal police work, " he shrugged in a news conference following the raid. "Sometimes you do have probable cause, you do take people in for questioning, and they're released."
So it's arrest 'em if they're brown first, and sort 'em out later. False arrest and imprisonment be damned.
Perhaps the U.S. Department of Justice and the FBI should follow Arpaio's way of doing things. There's probable cause enough out there that Arpaio's deprived others of their civil rights and done so under the color of law.
So arrest him, and sort out the details later.
And when he whines about it, play a video of Arpaio's statement above. Just do so when I'm around so I can watch the look on his flaccid face.
U.S. Attorney Dennis Burke has a grand jury ongoing, investigating Arpaio's alleged criminal misdeeds. The same question goes for those involved in that inquiry.
How many more innocent people have to be arrested? How many more cases of racial profiling do there have to be?
How many women will have their jaws busted and their arms broken, as has been the case for immigrant women held in Arpaio's jails?
It's not just women, of course. Last year Julio Mora, an American citizen, and his legal resident father were cuffed and held for three hours during the MCSO's violent immigration raid on Handyman Maintenance Inc., a county vendor.
Mora and his dad are now suing Sheriff Joe and the county. Ms. Ramirez should do the same, and extract her financial pound of flesh for Arpaio's misdeeds.
Arpaio acts as if he and his beige-shirts are above the law. They should not be. It's time for the feds to finally lay it down.
We're all tired of waiting. Tired of the excuses and dithering. Weary of watching yet another mother weep because of the way she was treated by Arpaio's roughneck Hispanic-hunters.
Look, I'm sorry to all of you who are calling this an outrage and whatnot, but why are you so upset? I mean, the article is obviously biased against the law but if you really read and know SB1070 then you see all it really does is enforce federal law. Don't ask where the feds are, they're backing this up. It is terrible that this girl was falsely arrested but plenty of people are falsely arrested every day, even when it is obvious they are not guilty. Why complain about 4 hours in handcuffs when hundreds of innocent people spend their entire lives behind bars. My dad is a white, middle class, working man and I didn't meet him until I was 5 because of a false arrest just because of the part of town he lived in. This is something that happens, and it's not just because she is latin american. It's a fact of life. Arpaio is doing what he, as a law official, believes is the best way to uphold the law and I think he's doing a pretty good job. There have been over 300 arrests since this legislation was introduced... So far, I've only read about 3 arrests that were false.

I was just held in LBJ and Durango for 4 days in medium security because I'm tan, and was pulled over on my skateboard at midnight because i wanted to avoid a storm and held out in jack in the box. my bail bondsman and my lawyer cannot find my mugshot anymore, my booking paper is completely wrong, i was arrested by an off duty gilbert cop who waited at an intersection of baseline and power in Mesa and she took me to phoenix, a fifty minute drive. and i was told that arizona would refuse me a lawyer because i was charged with "fugitive of justice" a class C felony. my lawyer practically jumped on my case, and im hoping to sue. it took 20 hours to book me, and i was slammed against the floor during my release because they kept twenty of us in a five by five room with a backed up toilet and the vents shut off, and i got pissed because they wanted to feed us instead of letting us go when i had made bail and technically a free man but treated like dog shit until i got outside. i called the CO a fat ass and next thing i know my thumb is behind my head near my ear and hes yelling at me to quit resisting. i have bruises that i took pictures of and sent to my lawyer. FUCK. JOE. ARPAIO.

<p>11 years ago, a person i worked with was committing crimes. i merely dropped him off at home sometimes. i was there when they raided. i got held for 4.5 hours for questioning to see if i was at all involved or could provide information that would boost their case. </p>

<p>According to police transcripts of the incident the lady in question was detained because she could not prove her citizenship, the reason she was asked to do so was because she had to driver license or state id card in her possession. The responsibility for her detaining was solely her own fault. She was detained during a sweep which would mean it would take sometime for processing and obtaining proper id. Again if you walk around without proper identification of who you are, you are responsible for the inconveniences you incurr.</p>

<p>From my experience and training:</p>
<p>If an officer walks up to someone and starts chatting with that person about the weather and fishing and the person can just walk away, there is no detention.</p>
<p>If an officer stops someone to talk to that person because of suspicious behavior (loitering in an area know for high drug sales activity) and starts asking the person, "Who are you? What are you doing here? Where are you coming from? Where are you going? Show me some identification."</p>
<p>A lawful detention has occurred. However, because there is no probable cause at that point that a crime has occurred, that person can simply say, "I'm waiting for the bus, but I guess I will walk home instead" and turn around an walk away. </p>
<p>Same scenario, but the officer sees a bulge in the pants pocket that looks like it might be the outline of a gun. The officer, for his safety and those around him, handcuffs the subject behind the back and conducts a cursory search, aka pat down, and finds that there are items in the pocket (hair brush and lip wax container) that made it look like the outline of a gun, but there is no weapon or any contraband discovered during the 'Terry Frisk'. </p>
<p>Again, a detention has occurred but no arrest has been made, even though the subject was handcuffed. </p>
<p>Same subject, but a gun is found during the pat down. Now a crime, carrying concealed weapon without a permit, has occurred and probable cause has replaced reasonable suspicion. An arrest has been made. </p>
<p>Once the arrest is made then a full search of the subject is made and suspected drugs, packaged for sale, are found in the suspect's shoes. These drugs were discovered during a 'search incidental to arrest' and the suspect can be charged after a field test confirms the drugs. </p>
<p>In this MCSO McDonald's case it appears there was no reasonable suspicion, much less probable cause, to hold Viridiana Ramirez, if she has what appeared to be valid identification, such as a driver license, state issued identification card, and social security card that matches. </p>
<p>Also, if any of the apparently Anglo employees were not held, and had no identification, but spoke 'clear' English, with no apparent Spanish accent, and didn't appear to have come from Mexico, the MCSO has a real problem with their protocol. </p>
<p>I wonder if the training has actually occurred and what that training consisted of.</p>
<p>I wonder if New Times might be able to get hold of video and hard copy information through FOIA on the training? MCSO will certainly be needing it for future civil actions filed against them for these kinds of 'sweeps'. </p>
<p>I wonder if any of the training information was shared with the Board of Supervisors. If not, why not? I think the BOS has a vested interest in knowing what kind of training is being given to MCSO employees to protect against civil actions.</p>

<p>A detention is a lesser intrusion upon the individual's privacy than an arrest. But what actually is a detention? A detention, from the word "detain," is a limit on the person's freedom by temporarily preventing his leaving. How much can you "limit" someone before you detain her? Where is the "bright line"? That line that once you cross over it, you have in fact detained someone? Good legal question. There is no definitive answer.</p>
<p>If a policeman walks up to you on the street and asks, "May I ask you a few questions?", have you been detained? The courts do not all agree on this one. All depends on the circumstances. In one federal case a judge argued in a dissenting opinion that any person of color approached by any white policeman would not feel free to say "no," and would, consequently, be "detained." Generally, the argument is that if you consider that a detention, then you take from the policeman the right of any citizen to ask a simple question of a stranger.</p>
<p>Consider the importance of the social context to this question. Suppose a man in a dark blue suit walks up to you and asks, "May I ask you a few questions?" in the airport at the site of a plane that has just arrived from Colombia. Are you detained? Do you feel that you can say "no," and walk away? Kind of depends on who you are, doesn't it? So this is a tough question where you have to consider the entire context. Technically, it's a detention if your freedom to walk away has been curtailed.</p>
<p>Nonetheless, a detention, preventing your leaving, asking you questions, is still much less than arresting you with the consequences that implies. An arrest means you are under official control. You may not leave the area at your will. A pat down search for weapons may be conducted if apparently necessary, and you will be booked. Clearly, the question is one of degree.</p>

Probable cause needs to be with specificity as to the person to be seized -- it is not about going in and arresting anyone with a shade of brown. </p>

I find it interesting that the majority of the arrests are made on Mexican nationals. Does this mean that Mexican nationals commit identity theft at a higher rate than other nationals that are here illeglly? Or could it be that there are many many many more Mexican and Central American illegal aliens in this state and the arrests are a reflection of the MASSIVE amounts of illegals from south of the border?</p>
<p>You want to say he only targets hispanics(what you really mean is Mexican nationals) but I challenge you to go find large groups of non-Mexican nationals illegally working en masse in a Phoenix company. </p>
<p>I've been in a lot of companies in the valley and have yet to run into a company employing tens of Chinese, African, Swedish, or otherwise non-Mexican nationals. </p>
