Who can best whup Andy Thomas' tuchis, Gerald Richard or Tim Nelson?

As I mentioned briefly in this week's Bird column, I made the spring meeting of the Maricopa County Dems this past Saturday, mainly because I wanted to size up the two guys looking to replace Republican County Attorney Candy Thomas this year, Gerald Richard and Tim Nelson.

Both men have beaucoup more experience than Thomas did before he was elected. Richard just retired from the PHX PD after 18 years as a lawyer/administrator for them. In 1993, he became the first Director of the PHX PD, a civilian position on par with an Assistant Chief. And most recently, he's been responsible for keeping us safe during the SuperBowl, the immigration protests at Pruitt's, and the massive pro-immigration marches that occurred in 2006. Also, before he was with the PD, he prosecuted hard-core criminals as a Deputy County Attorney. That's unlike Thomas, who's never personally prosecuted a felony case that anyone knows about.

Tim Nelson is the Governor's boy, having been Napolitano's general counsel for the last five years. He also worked for Janet back when she was AG, and prosecuted some big-time white collar cases involving the tobacco and pharmaceutical industries. As I mentioned in The Bird, the word on the street is that Napolitano's already making calls on his behalf, though both he and the Guv's flack deny it. Currently, he's working for the law firm of Osborn Maledon, known as a nesting place for Nappy loyalists. He expects the governor's endorsement, and he informed county Dems during his speech that he plans to raise a buttload of cash from all of his bigshot lawyer buddies.

"I’m going to raise so much money," he promised the Dems assembled in a central Phoenix union hall. "I’m going to raise more money I predict by June 1st than Andy Thomas raised in the entire last cycle. That’s my goal. We’re going to bring the kind of financing to beat this guy. We have to win this race. It’s too important, and we need all your energy."

I'm no fan of Janet. She's a do-nothing governor, a Clintonesque fence-straddler who never expends any political capital unless it benefits her career. I suppose she'll be of help with fundraising, but I doubt the value of her endorsement for Nelson or anyone else. It didn't get Obama over the hump to take Arizona in the Presidential primary here. Nor did it assist Laura Pastor, who failed to nab a Phoenix city council seat with the Guv's backing. Nelson shouldn't be so sure he's a shoe-in because of it.

On the other hand, I did like Nelson's pointed criticism of our current County Attorney, particularly regarding Thomas' employment of his ex-boss Dennis Wilenchik as a special prosecutor in the New Times case. Nelson spoke eloquently of Thomas' abuses of power.

"Abuses like these bogus subpoenas to the New Times seeking information about every one of us that read that paper online," emphasized Nelson. "Not just that, but the records of what Web sites you visited immediately prior to visiting the New Times Web site. Think about how invasive that is.”

Later, he declined to criticize Thomas for approving RICO funds for the MCSO's Honduras excursion (as did Richard), but he quickly turned his answer into an attack on Thomas.

"I don’t know enough to know whether the CA was involved in misusing RICO in the Honduran case," said Nelson. "But I can say for sure that he’s misused RICO money on the advertising that we’ve seen...on ads that are shameless like these DUI ads where his name takes up a third of the billboard. Or these truancy ads where he’s the talking head on TV."

By contrast, Richard is more charismatic on the podium than Nelson. This is just an initial impression, but he has a dynamic and forthright style, almost like a preacher. And he speaks with a certain authority. Some of that may be age. Nelson is 44. Richard will be 53 in May. The years, and what he's done with them, add gravitas to Richard.

He mostly spoke of himself during his speech, spending less time on attacking Thomas this time around and more on introducing himself to the crowd. I liked the joke he opened with, an oldie but a goody:

"I’m from the South Side of Chicago," he explained. "I came here in 1973 on a track scholarship. When you’re born in Chicago, you’re automatically a Democrat. And should I die and they send my body back, I get four more years to vote."

Richard spoke of his experience prosecuting criminals and working with the Arizona Supreme Court, having chaired the Arizona Supreme Court Commission on Minorities for many years. After his remarks, I sat down with him for a few minutes. I asked if his work on the Supreme Court's Minorities Commission would give ideological ammunition to Candy.

"I’m waiting for someone to call me a liberal," said Richard. "Because when they do, I’m going to tell them, ask the guy I put away for 10.5 years how liberal that was. Ask the one who got 15 years how liberal that was."

Like Nelson, Richard told me he supports the suggested changes to the PHX PD's operations order regarding the questioning of individuals about their residency status. He did, however, object to the CA's focus on demonizing illegal aliens.

"I’m going to use the same resources and prosecute anyone who breaks the law, keeping them here in the U.S., so you don’t have situations where they’re going across the border and coming back and killing another one of my officers," Richard promised.

There's plenty of racism in Maricopa County, even though Phoenix itself tends to lean left-of-center. Two of the most powerful county-wide positions are held by men who're pursuing bigoted policies, Thomas and Arpaio. So how does Richard, as an African-American, plan to overcome that racism?

"When [voters] look at the candidate what I ask of them is take a look at the man and the experience, and ask who is best to beat Andrew Thomas in this upcoming race," said Richard, speaking of Democratic voters here, obviously. "That’s all I’m asking. Now when they look at everything else, after they’ve seen all of that, there are going to be those who say I just can’t do it. And there are going to be the others who say that man has everything that it takes."

But it's not the Democratic voters I'm worried about, but rather those he'll face in the general election. On the other hand, this is the age of Obama, and Richard cuts an impressive figure as a candidate, a Samuel L. Jackson-esque politician ready to put his foot in Candy Thomas' ass, then in the asses of the county's criminals.

The good news for Dems is that either Nelson or Richard has the chops to take Candy, who is hobbled by scandal and clinging desperately to Sheriff Arpaio's pant legs. So let the best man win, and then get busy making sure Thomas returns next year to his old employer Wilenchik & Bartness.

Sounds good to me. Richard`s expertise speaks in volumns. The only thing I'm worried about is those masses of average dimwits who judge a book by its cover rather than read what its truly about, and ironically many of them are KKKonervatives. That's the sad part. Because they are already destroying our country.
The other dude Nelson may raise a lot of dough, he's wise and willing to usurp Andrew`s throne yet, he agrees with us that Candy "lil` joe" Thomas was misusing RICO funds to promote himself. Both did not give clear answers about the Honduran Adventures with "Jabba the Hut" Hendershott and his ilk. But yeah, I'm leaning towards Richard on this one.....

Let me see..mmm...Governor Napolitano appoints Maricopa County Superior Court judges, the Director of the Arizona Department of Corrections; Napolitano was a former prosecutor and Attorney General, and now she wants her legal side kick of many years, to become Maricopa County Attorney??? Too much power and control for one person to wield over us!

Sounds like some independent oversight is needed here before once again the Governor controls the powerful position of Maricopa County Attorney. Aren't people paying attention to why the state and county are in serious financial straits? Or is it that the public is not being informed -- control of what the media covers.

One person, the Governor, controlling the billions of tax payers' dollars and the budgets (which are out of control), and the prison system (broken and out of control, approaching one BILLION dollars) and criminal justice system (broken and out of control, run by former prosecutors) should raise red flags where freedom and independence is valued.

People do not matter to the present elected officials running Arizona into the ground when they operate with their own self-interest and are only care about POWER, CONTROL AND MONEY. These officials have no conscience or soul, and lack respect for humanity and the taxpayers who elected them. Arizona under this administration is eating it's own people and destroying what was once a fine state.

When people write the Governor, she deflects them away saying it's not in her area, but to contact the Maricopa County Attorney. When one writes to AG Goddard, Campagnola sends an empty letter, contact the County Attorney, and on and on. The elected officials are not doing their jobs for the people and have chosen to remain dormant, while serious issues go unattended and swept under the rug.

For one person, the Governor, to have that much control over the people is chilling.

Because of all this, I would NEVER support Tim Nelson. A vote for Tim, is a vote for Napolitano to also control the County Attorney's office. We can't allow that. The public should be made aware of the conflict of interest and ongoing abuse of power in the state. Stephen and the owners of the New Times, hope you write about this. Keep up the outstanding work, as a single brave and courageous voice in the State of Arizona, while the others are controlled by the propaganda handed to them by Candy Thomas and Blow-hard Joe.

It is disgusting to think any of our sheriff's and his goons and those who supported them for the Honduras escapade would be doing anything meaningful for the taxpayers in Maricopa County, except to go there to learn Third World tactics to bring home.

We've had enough Third World tactics in this county and state. It's time to move into the 21st century and get rid of the dictatorships that control and manipulate the people and take their money.

RICO funds should be accounted for and NEVER used for advertising any person looking for political and career gain. The people of Maricopa County and the State of Arizona have been exploited long enough by the power brokers.

I'm leaning toward Richards. I like his experience with PPD, something neither Nelson nor Thomas has. Plus, Richards has prosecuted street crime, which is primarily what the County Attorney's Office does.

That white collar stuff is very different. What does Nelson know about the County Attorney's Office and how a place like that needs to be run?

Tim Nelson has brought millions of dollars into Arizona by sucessfully suing international pharmaceutical companies for price fixing and keeping generic drugs off the market. He represented Arizona against big tobacco companies too. I have heard good things about Gerald Richards too, but I believe Tim Nelson is the better lawyer.

BOTH are better than Thomas! According to a Judge I recently spoke with, Thomas STILL has not managed his own criminal trial, just a couple of juvenile cases. Poor guy has to outsource all his legal work to his old boss. tsk tsk.

I think Tim Nelson is the most capable. He knows how to litigate complex cases, how to manage a legal team, and gets things done.

Remember, this job is to be the top LAWYER for one of the biggest counties in the USA. Not Police Chief or Sheriff. My vote will be for Tim Nelson for County Attorney.

Cant imagine Wilenchik siding with Thomass after andy wipped his bugger on him when he got caught making the wrong decision to arrest the phx new times . (And dont forget how Wilenchik let trish Groe Off for DUI!!!!!!!!!! little ironic andy has his name all over the posters for dui and then special prosecutor lets her off?!?!!! Special treatment for those in office.!

The bottom line -- it will take significant resources to throw Thomas out. It sounds like Nelson has access to those resources. All I care about is that Thomas is shown the door. Nelson has the best change to do that. Thomas would be licking his chops to face Richards in November!! A vote for Richards is akin to a vote for Ron Paul. It might make you feel good, but you wasted the gas driving to the polling station.

Enough damage has been done by County Attorney Thomas and Arpaio. It's time for them to move on, so we can salvage what remains of the county and state and begin to rebuild.

I wouldn't trust a single elected official with the money that is going to come pouring in from Homeland Security for the Border War in Arizona. Voted for Thomas in 2004 and will not make the same mistake again. After CA Romley with his wretched demeanor and 24/7 grandstanding watching him destroy lives on a daily basis, Thomas seemed a refreshing choice. We were fooled, and found that we had voted in a "wolf in sheep's clothing."

We need someone to clean up the streets of crime, not hunting down people in the schools, offices, businesses and upscale suburban homes with Swat teams sent out on misdemeanors. Thomas and Arpaio must go and take their abuse of power with them. Where's the Arizona Bar on abuse of power by one of their own?

The thing is, we need legal ability AND the political contacts AND financial resources to toss out Thomas. Tim Nelson has that and will beat Andy Thomas.

No argument, Gerald Richards may be a great guy with good experience in the trenchs, but he may be perceived as a "little" guy in the legal world. What type and how many cases has Richards argued and at what level? Has Richards argued before the Supreme Court, Appellate Courts? Has he argued issues before the state and US legislatures? Those things are important too because that is how laws are changed and modified and how the legal community moves forward. I doubt Richards can beat Thomas.

Remember, this is for top attorney for one of the biggest counties in the country.

That's a pretty elitist argument "88golong." Arguing before appellate courts is a relatively minor part of what the County Attorney's Office does. They have less than 10 attorneys in an office of 300+ who are dedicated to that. All direct appeals are handled by the AG's office, not MCAO. They mostly only handle
PCRs.

As for lobbying the legislature, that's what part of Richard's job was at PPD. In order to get laws changed in a GOP dominated legislature, we'd have a better chance with someone who's not tied to the governor they hate so much over there.

Street-smarts is what we need. Richard is a guy who knows law enforcement from both the prosecutorial and police perspectives. Neither Nelson nor Thomas can say that. That's why he's the best choice.

Thank goodness Gerald Richard is running for the Maricopa County Attorney's Office. Mr. Richard is a very smart and intelligent man. Mr. Richard brings the experiance of a trial attorney with tons of criminal law and trial experiance. I have been a Peace Officer for 31 years and have had the honor of working with Mr. Richard in felony criminal cases and investigations that have resulted in the arrests and convictions of violent felons.

As a high ranking member of the Phoenix Police Department, Mr. Richard has always made the time to meet with members of our communities and organizations to address areas of concern and to formulate solutions that benefited the community.

Mr. Richard knows what it takes to stabilize and bring back the respect to the county attorney's office that has been lost under the failed leadership of Mr. Thomas. I can tell you it will be a long awaited and welcomed change within the county attorney's office when Thomas is voted out. Help bring, honor, credibility, and stability to the Maricoipa County Attorney's Office and at the same time help to retain current county prosecutors, support personnel and boost overall employee morale by voting for Gerald Richard. My vote is for Gerald Richard.

Gerald Richard is the only man for the job. When he wins the primary, he will get the money and resources needed to fire andrew thomas. Tim Nelson doesn't have the street smarts or the leadership skills needed to lead the county attorney's office out of the whole Thomas has dug it into.
